الملخص
الملخص: تناولتُ في هذا المقال علاقة التاريخ بالفقه وبالضبط علاقة التاريخ الحضاري بالنوازل الفقهية، وبعد تعريف النوازل ومختلف المصطلحات الدالة عليها عرّجتُ على مجموعة من المحاذير التي وجب على الباحث أخذها بعين الاعتبار حتى يمكن لنتاجه وتحليلاته أن لا تُجانب الصواب كضرورة فهم لغة الفقيه ومدلولاتها والتدقيق في " المكان" و"الزمان" الذين احتضنا النازلة ، ثم التفريق بين ما هو "واقعي" وما هو "افتراضي"، وبين ما هو "عام" وما هو "خاص". وحتى لا تبقى دراستي نظرية عرّجتُ على بعض الدراسات التي اعتمَدَت على مثل هذه المصادر من المستشرقين والشرقيين ، وختمتُ بإبراز أهم القضايا التي تناوَلَتْها أو يمكن أن تتناوَلُها مثل هذه المصادر، متخذا من "نوازل الونشريسي" أنموذجا . Summary : This article dealt with the relationship between the Fikh and history and more specially the relationship between contemporary history and « Fikh contempopary issues » (Nawazil) . After giving a difinition of the « Nawazil » the different terminologies related to it we went to the warnings that the researcher had to take in consideration like the necessity of understanding the language of Fikh and what it refered to and concentrate on the place and the time which embrace Nawazil, then differenciate between what is « real » and what is « virtual » and between what is « general » and what is « special ». In order not to be theoretical, I have taken in consideration the work of some oriental sources. Finally I concluded by focusing on the most important issues that these sources dealt with taking « nawazil el-wansharisi » as an example.
