الملخص
الملخص يعد التلوث البيئي من الأخطار التي تؤثر على صحة الإنسان وتهدده في كيانه ومستقبله، ويأتي تلوث الهواء في مقدمة هذه الأخطار؛ فتلوث الهواء یهدد البيئة الإنسانية بأكملها حيث لم يعد يشكل مشكلة خاصة ببلد معين بذاته، بل إنه تخطى الحدود، وأضحى مشكلة عالمية. ويتلوث الهواء بفعل عدة عوامل أهمها الغازات التي تنبعث من عوادم السيارات والمصانع، والأكاسيد الناتجة عن احتراق الوقود الأحفوري كالفحم الحجري والنفط والغاز الطبيعي، والنشاطات الطبيعية كالبراكين وحرائق الغابات وغيرها. ويعد الدخان المنبعث من منتجات التبغ مصدراً آخر من مصادر تلوث الهواء؛ فهو يلوث البيئة المحيطة ولا يضر بصحة المدخنين فحسب بل يمتد ضرره ليطال غير المدخنين ممن يتواجدون في المكان والذين أثبتت الدراسات العلمية أنهم يتضررون أكثر من المدخنين أنفسهم ولذلك أُطلق عليهم مصطلح المدخنين بالإكراه أو المدخنين قسرياً. هذا البحث يناقش مسألة قانونية هامة ألا وهي حق المدخن السلبي في مقاضاة المدخن الإيجابي للمطالبة بالتعويض عن الأضرار الناجمة عن تعريضه لدخان السجائر، وإلى أي مدى قد يجد هذا الحق صدى لممارسته وتطبيقه في أروقة المحاكم في الأردن. The Right of the Passive Smoker to Sue the Positive Smoker to Claim Compensation for Damages Caused by Exposure to Cigarettes Smoke - Part One - Abstract Environmental pollution is one of the dangers that affect human health and threaten his entity and future. Air pollution comes at the forefront of these dangers; it threatens the entire human environment where it is no longer a problem for a specific a country, but it went beyond borders, and has become a global problem. Air may be polluted by several factors, the most important of these are the gases emitting from automobiles and industry, oxides resulting from the combustion of fossil fuels such as coal, oil and natural gas, and natural activities such as volcanoes, forest fires and others. Smoke comes out of tobacco products is another source of air pollution; it pollutes the surrounding environment and it does not only harm the health of smokers but it also harms non-smokers who are existed in the place concerned and who the scientific studies have shown that they can be affected more than the positive smokers themselves, thereby they are called the coercive smokers. This article discusses an important legal issue; that is the right of the passive smoker to sue the positive smoker to claim compensation for damages caused by exposure to cigarettes smoke, and the extent to which this right may find response for its practice and application in the court halls in Jordan.
