نظام المثول الفوري بديل للمحاكمة بإجراءات الجنح المتلبس بها

الملخص
المثول الفوري آلية حديثة لتجسيد إجراءات محاكمة المتهم من طرف محكمة الجنح في الجرائم المتلبس بها ، دون الحاجة إلى تحقيق مع تعزيز حق المتهم في الاستعانة بمحام للدفاع عنه. جسد نظام المثول الفوري مبدأ حماية الحريات الأساسية من خلال إعطاء المشرع صلاحيات أوسع للقاضي بدلا من النيابة الممثلة لجهة الاتهام، في تقييد حرية المتهم أو لا بالنظر إلى ظروف الجريمة والمجرم. تطبيق نظام المثول في الجنح المتلبس بها لا يعني التخلي عن إجراءات التلبس المنصوص عليها قانونا في بعض الحالات الإجرامية مع ضمان حقوق وحريات المتهم في المحاكمة عادلة، فالعدالة لا يمكن أن تتحقق في ظل نظام لا يحترم حريات الأفراد والضمانات الأساسية للمحاكمة. Résumé de l'article:(Français) Le système de la comparution immédiate alternative au procès pour délits. La comparution immédiate c’est un mécanisme moderne pour légitimer le procès de l'accusé par un Tribunal correctionnel dans les crimes commis, Sans avoir besoin d'une enquête, tout en renforçant le droit de l'accusé à un avocat pour sa défense. Le système de la comparution immédiate incarne le principe de la protection des libertés fondamentales en conférant au législateur des pouvoirs plus étendus au juge plutôt qu'au procureur représentant l'accuséen restreignant la liberté de l'accusé ou non, en tenu compte des circonstances du crime et du délinquant. L'application du système de comparution ne signifie pas l'abandon des poursuites judiciaires dans certaines affaires criminelles, tout en garantissant les droits et libertés de l'accusé dans un procès équitable, la justice ne peut être réalisée sous un régime qui ne respecte pas les libertés individuelles et les garanties fondamentales du procès. Article Summary:(English) The system of the immediate attendance an alternative to the process for crimes. The immediate attendance is a modern mechanism to legitimize the trial of the accused by a Correctional Court in crimes committed, Without the need for an investigation, while strengthening the right of the accused to a lawyer for his defense. The Immediate attendance system embodies the principle of the protection of fundamental freedoms by giving the legislator broader powers to the judge rather than to the prosecutor representing the accused by restricting the liberty of the accused or not, taking into account the circumstances of the crime and the offender. The application of the attendance system does not mean the abandonment of legal proceedings in certain criminal cases, while guaranteeing the rights and freedoms of the accused in a fair trial.
