ملخص الفرنسية: L’étude porte sur le régime juridique de la question d’inconstitutionnalité, en tant que mécanisme permettant de contrôler à postériori la constitutionnalité des dispositions normatives, dans les systèmes juridiques de l’Algérie, la France et l’Espagne, selon une approche comparative, qui consiste à examiner le champ d’application de la question, les conditions de sa recevabilité, ses procédures et les effets de l’arrêt rendu par le juge constitutionnel dans ces systèmes. Elle vise à évaluer le traitement juridique de la question d’inconstitutionnalité dans ces trois systèmes juridiques, afin de déterminer l'approche la plus efficace pour atteindre l’objectif de purger l’ordre juridique de l’Etat des normes inconstitutionnelles. ملخص الانجليزية: The study examines the legal regime of the question of unconstitutionality, as a mechanism for post-review of the constitutionality of normative provisions, in the legal systems of Algeria, France and Spain, according to a comparative approach, which consists in examining the scope of the question, the conditions of its admissibility, its procedures and the effects of the judgment of the constitutional judge in these systems. It aims to evaluate the legal treatment of the question of unconstitutionality in these three legal systems, in order to determine the most effective approach to achieving the goal of purging the state's legal order of unconstitutional norms.
