الملخص

مرت البلدان النامية-لا سيما البلدان المنتجة للبترول -بظروف دفعت بها إلى المطالبة بحقوقها من شركات النفط الأجنبية العاملة على أراضيها، وبسبب عدم تلبية هذه الشركات لمطالبات حكومات هذه البلدان اتخذت بعض هذه البلدان اللجوء إلى التأميم الذي يقوم على أساس نقيض للأسس التي تقوم عليها الرأسمالية بخصوص ملكية وسائل الإنتاج، فهو مطلب يتحقق بتحقيق الاشتراكية داخل مجتمع معين. وقد توصل الباحثان إلى مجموعة من النتائج من أهمها: -أن نقل ملكية المشروع (المؤمم) مباشرة إلى الدولة يزيل شخصيته المعنوية، ويتخذ شكلاً قانونياً جديداً قد يكون على شكل مؤسسة عامة أو شركة حكومية أو شركة مساهمة، بحيث ينطوي تحتها صورتان هما صورة الاندماج وصورة التصفية. أمّا أهم التوصيات فكانت: -ضرورة قيام المشرع العراقي بإصدار قانون للتأميم جديد يواكب تطورات العصر، يتضمن كافة الأحكام القانونية المتعلقة به في تشريع قانوني واضح ومفهوم للجميع.
