التعاون اللامركزي في مجال حماية البيئة من التغيرات المناخية والطاقة في القانون الجزائري (بلدية باتنة نموذجا)

الملخص
لقد طور المشرع الجزائري منذ استقلال الجزائر إلى يومنا هذا من مجال صلاحيات الجماعات الإقليمية، المتمثلة في كل من البلدية والولاية، ومكنهما من آليات جديدة من أجل رفع التحدي الذي تواجهه على مستوى إقليمها و جوارها، حيث أوكل إليهما اختصاص حماية البيئة من التغيرات المناخية والطاقة، ففتح لهما مجال الشراكة و التعاون اللامركزي بموجب المرسوم التنفيذي رقم 17/329 المؤرخ في 15/11/2017، الذي يحدد كيفيات إقامة علاقات التعاون اللامركزي بين الجماعات الإقليمية الجزائرية والأجنبية، بذلك طور من طابع التعاون، فلم يعد يشمل المجالات التقليدية، و إنما استحدث مجالات حديثة و جديدة، اتسعت لتشمل مختلف المجالات، التي من بينها حماية البيئة من التغيرات المناخية والطاقة، وومن خلاله واكب التطور الدولي، و فتح المجال للجماعات الإقليمية للانفتاح على العالم الخارجي من أجل التعاون مع الجماعات الإقليمية الأجنبية المجاورة لهما، لتفعيل دورها في مهمة حماية البيئة من التغيرات المناخية و الطاقة، و تطوير و تنمية علاقات التعاون، مع نظيراتها الأجنبية، و سنشير في هاته المقال إلى الاتفاقية المبرمة بين بلدية باتنة و الاتحاد الأوربي في مجال حماية البيئة من التغيرات المناخية و الطاقة، كتجسيد و تفعيل إلى ما أراده المشرع الجزائري. Abstract: Since Algeria's independence till today, the Algerian legislator has developed the prerogatives of regional assemblies ( the municipality and the state ), And enabled them to develop new mechanisms to raise the challenge it faces at the level of their region and vicinity where they were assigned the task of protecting the environment from climate change and energy. They opened the area of decentralized partnership and cooperation under executive decree No. 17/329 of 15/11/2017, which defines the modalities of establishing decentralized cooperation relations between the Algerian regional groups and the foreign ones. Thus, it has developed the nature of cooperation, which no longer covers conventional areas, but has developed modern and new fields, which have expanded to cover various fields, including the environmental protection against climate change and energy. Thus also keeping pace with international development and opening up space for regional groups to open up to the outside world for cooperation with neighboring foreign regional groups to activate the task of protecting the environment from climate change and energy and to develop cooperation relations with their foreign counterparts. key words: Regional groups; the municipality of Batna; the European Union; decentralized cooperation convention; the environment protection; climate change; energy.
