النظام النوعي لعلاقات العمل المتعلقة بالصحفيين

الملخص
تقوم علاقات العمل في التشريع الجزائري على أساس تعاقدي تطبيقا لأحكام القانون 90-11 المتضمن علاقات العمل،ومن أجل التحديد الدقيق لنطاق التطبيق،أوردت المادة الثانية منه تعريفا مباشرا للعامل الأجير وإستناجيا للمستخدم ولعناصر عقد العمل ،كما استثنى ذات القانون الفئات التي لا تخضع لأحكامه. وبين الفئات التي تخضع لأحكام قانون العمل والفئات التي تستثنى من الخضوع لأحكامه ،توجد فئات تصنّف ضمن فئة العمال الأجراء،غير أن طبيعة علاقة العمل التي تقوم بها تستدعي تنظيمها بأحكام نوعية خاصة وهو ما يعرف بالتنظيم النوعي لعلاقات العمل أو ما يصطلح على تسميته بالقوانين الأساسية في قانون الوظيف العمومي.ومن بين الفئات التي تخضع للتنظيم النوعي لعلاقات العمل فئة الصحفيين. تتناول الورقة البحثية المقدمة النظام النوعي لعلاقات العمل المتعلقة بالصحفيين من خلال التطرق للإطار القانوني الذي ينظم هذه العلاقة. Abstract: Labor relations in Algerian legislation are based on contractual terms in accordance with the provisions of Law 90.11, which includes labor relations. In order to determine the precise scope of application, article 2 provides a direct definition of the employee and methodological employee and the elements of the contract of employment. The same law excluded categories that are not subject to its provisions. Among the categories subject to the provisions of the Labor Law and the categories that are excluded from the provisions of the Labor Law, there are categories that are classified as workers' employees. However, the nature of the employment relationship requires special regulation, which is known as the qualitative regulation of labor relations, Public employment law. Among the categories that are subject to qualitative regulation of working relations is the journalists category. This present paper discusses the qualitative system of labor relations relating to journalists by addressing the legal framework governing this relationship.
