قراءة نقدية في تفويض المرفق العام على ضوء المرسوم الرئاسي 15/247 والمرسوم التنفيذي 18/199.

الملخص
يعتبر المرسوم الرئاسي رقم 15/245 المتعلق بالصفقات العمومية وتفويضات المرفق العام، والمرسوم التنفيذي رقم 18/199 المتعلق بتفويض المرفق العام، محطتين قانونيتين اساسيتين والتي تسمحا بتسيير واستغلال المرافق العمومية من قبل مختلف المتعاملين عن طريق أساليب تفويض مختلفة تتمثل في الامتياز، الإيجار، الوكالة المحفزة والتسيير. كما يمكن أن يأخذ أساليب اخرى، وهو ما من شانه تخفيف العبء على الدولة وتحقيق المردودية والنجاعة للمرافق العامة باعتبارها الوسيلة التي من خلالها تستطيع الدولة إشباع الحاجات العامة للمواطنين. غير أن تنظيم أحكام تفويض المرفق العام ضمن المرسومين يطرح عدة إشكالات وثغرات قانونية سواء من الناحية الشكلية او الموضوعية الأمر الذي اوجب الوقوف عليها والعمل على دراستها وتحليلها وانتقادها، محاولين بذلك اقتراح بعض الحلول المناسبة عندما يقتضي الامر. Abstract the delegation of the public service which is included in the presidential decree 15/247 related of the public procurement and public service delegation and executive decree 18/199 related to the public service delegation considered as one of modes that allow to managing and exploiting the public service from all the transactors by various exploiting ways: the concession, the lease, cost plus contract, and the management. Also its can be by an other modes. That what make a less burdens on the state and make more profitability and effectiveness for public service because they are the tools of the state to realize her people public widgets gratification but the regulation of rulings for delegation of the public service by the presidential decree 15/247 and the sending to the executive decree 18/199 posses a several problems and legal gaps from both formally and objectively sides for those reasons we most Studied and analyzed it and trying to give some solution for it .
