التشريع عن طريق إبرام المعاهدات الدولية وأثره على مكانة البرلمان السيادية في الجزائر وتونس وفقا لمستجدات الإصلاحات الدستورية

الملخص
ملخص: إن المؤسسة التشريعية ممثلة في البرلمان تلعب دورا أساسيا لا يقل أهمية عن دور السلطة التنفيذية في الحياة السياسية داخل الدولة الحديثة التي تكرس مبدأ الديمقراطية بمفهومه الواسع، والحديث اليوم عن تفعيل دور البرلمان في الرقابة على المعاهدات الدولية التي تبرمها السلطة التنفيذية يرتبط في الحقيقة بجوهر وأساس الديمقراطية بغض النظر عن طبيعة النظام القائم، فالعمل على توطيد دعائم البناء الديمقراطي يمر حتما عبر تمكين السلطة التشريعية من القيام بمهامها الدستورية الأساسية التشريعية منها والرقابية بصورة سيادية، وذلك بفعالية تضمن استمرار البرلمان كمؤسسة دستورية تجسد المشاركة السياسية التمثيلية في التعبير عن الإرادة الشعبية، كما أن هذه المهمة المنوطة بالسلطة التشريعية تحكمها مجموعة من المحددات التي تفرزها المنظومة الدستورية السائدة في أي دولة، والتي تساهم في تحديد شكل ومكانة البرلمان ضمن منظومة المؤسسات الدستورية. Abstract: The legislative institution represented in the parliament plays a fundamental role and no less important than the role of the executive authority in the political life within the modern state, which enshrines the principle of democracy in its broad sense, and today's talk about activating the role of Parliament in the control of international treaties concluded by the executive authority is in fact linked to the substance and basis Democracy Regardless of the nature of the existing system, the work to consolidate the foundations of democratic building inevitably passes by enabling the legislative authority to carry out its basic constitutional functions, legislative and control, in a sovereign manner, effectively to ensure the continuation of Parliament As a constitutional institution that embodies representative political participation in the expression of popular will. This task of the legislative authority is also governed by a set of determinants that emerge from the constitutional system prevailing in any country, which contributes to determining the form and place of parliament within the system of constitutional institutions.
