قيود الملكية العقارية الخاصة - قيد حق المرور لمالك الأرض المحصورة -

الملخص
أعطى المشرع الجزائري، على غرار المشرعين العرب وغير العرب، حق المرور لمالك الأرض المحصورة التي ليس لها ممر إلى الطريق العام، أو لها ممر لكن هذا الممر لا يسمح للمالك باستغلال هذا الملك بالشكل الذي يريده؛ وذلك نظرا لضيق الممر، أو صعوبة انحداره والمخاطرة أثناء استعماله، وربط التمتع بهذا الحق بشرطين أساسين هما: ألا يكون المالك هو الذي كان السبب في حصر ملكه بعمل مادي أو تصرف قانوني. ألا يكون المالك يتمتع بحق مرور إلى الطريق العام على وجه التسامح أو الاتفاق، أو يتمتع بحق مرور متنازع فيه. كما حدد المشرع الجزائري حقوق والتزامات كل من مالك العقار المرتفق بالمرور ومالك العقار المرتفق به، وأسباب انقضاء هذا الحق، وإمكانية اكتسابه بالتقادم إذا تحققت شروط معينة. Résumé: Le législateur algérien a attribué à l'instar des législateurs arabes et non arabes le droit de passage au propriétaire d'un fonds enclave qui n'a pas d'issue sur la voie publique ou qui a une issue ne permettant pas d'exploiter cette propriété de la façon qu’ il veut, et ce compte tenu de l'étroitesse de l'issue ou de son caractère accidente et le risque qu’il en court pendant son usage . À cet effet, le législateur algérien a soumis la jouissance à deux conditions essentielles, à savoir : 1-Que le propriétaire ne soit pas la cause de l'enclavement de sa propriété par un fait matériel ou agissement juridique. 2-Que le propriétaire ne jouisse pas du droit de passage à la voie publique par tolérance ou accord ou jouisse d'un droit de passage litigieux. Le législateur a également précisé les droits et les obligations du propriétaire du fonds servant et ceux du propriétaire du fonds enclave et les causes de l'extinction de ce droit, en plus de la possibilité de son acquisition par prescription si des conditions précises sont réunies. Abstract: The Algerian legislator has assigned, like Arab and non-Arab legislators, the right of passage to the owner of a confined funds that has no way on the public highway or has a way does not allowing him to exploit this property by the way that he wants, and that given the closeness of the outcome of his accident or character and his risk in during use. To this effect, the Algerian legislator has subjected the enjoyment to two essential conditions which are: 1-The owner isn't the cause of the isolation of his property by a material fact or legal act. 2-The owner doesn't enjoy the right of way to the highway by sufferance, agreement or enjoy a right of disputed passage. The legislator has also determined the rights and obligations of the owner of the servant estate by the passage and the owner of the confined funds and the causes of the extinction of that right, in addition to the possibility of its acquisition by prescription if specific conditions are met.
