الحماية الدولية للنازحين داخلياً

الملخص
الملخص تعد مشكلة النزوح الداخلي من أبرز المشاكل خطورة اليوم والتي تلقي بظلالها على المجتمعات التي تعاني من مشاكل داخلية مختلفة تولد هذه الظاهرة، ولا سيما النزاعات المسلحة التي تؤدي إلى نزوح المدنيين عن أماكن سكناهم، وما يترتب على ذلك فيما بعد من مآسي إنسانية تهز الضمير العالمي. وهذه الظاهرة بدأت بالتنامي والتزايد في السنوات الأخيرة، ولاسيما في منطقة الشرق الأوسط نظراً لما تشهده هذه المنطقة من نزاعات مسلحة، وبصورة خاصة في العراق وسوريا وليبيا واليمن. ورغم خطورة هذه الظاهرة وأثارها المؤلمة والمأساوية نجد أن المجتمع الدولي لم يولي الإهتمام الكافي به، حيث لا توجد إلى اليوم إتفاقية دولية معنية بهذه الموضوع تبين لنا حقوق النازحين داخلياً وحقوقهم وكيفية حمايتهم والآليات الكفيلة بذلك. كما أن جهود منظمة الأمم المتحدة في هذا الصدد ليست بمستوى جسامة هذه الظاهرة وخطورتها، حيث أنها أكتفت بإصدار مبادئ توجيهية خاصة بالتشريد الداخلي عام 1998، وهي عبارة عن مبادئ إسترشادية غير ملزمة، ولا يمكن التعويل عليها كثيراً في توفير الحماية للنازحين داخلياً، وكذا هو الحال المستوى القاري حيث ليست هناك سوى اتفاقية كمبالا لعام 2009 في أفريقيا تتطرق لهذا الموضوع، رغم أنها مشكلة تعاني من قارات أخرى كأسيا وبالتحديد المنطقة العربية. ومن هذا المنطلق وفي غياب الجهود الفعالة لمعالجة هذه المشكلة أرتأينا البحث فيه من خلال تناول الموضوع في مبحثين، الأول نتطرق فيه إلى التعريف بالنازحين داخلياً، والثاني لمصادر الحماية الدولية لهم. Abstract The problem of internal displacement is one of the most serious problems today, which cast a shadow on the communities that suffer from various internal problems generate this phenomenon, in particular armed conflicts that lead to the displacement of civilians from their places of residence, and the consequent of it later which are humanitarian tragedies shake the conscience of the world. This phenomenon began to grow and grow in recent years, especially in the Middle East because this area witnesses armed conflicts, particularly in Iraq, Syria, Libya and Yemen. Despite the seriousness of this phenomenon and it's painful and tragic effects, we find that the international community did not pay enough attention to it. Where there are no till today an international convention on this subject shows us the rights of IDPs and their rights and how to protect them and the mechanisms to do so. The United Nations Children's efforts in this case is not of that level of the gravity of this phenomenon and and it's seriousness, where they just issue a special Internal Displacement guidelines in 1998,which is about guiding principles that are non-binding and cannot be relied upon frequently to provide protection for internally displaced people. as well as it is the case of continental level where there is only a Kampala Convention in 2009 in Africa to address this issue, Although other continents suffer from this problem such as Asia and the Arab region in particular. From this point and in the absence of effective efforts to address this problem, we decided to search by studying the subject in two sections, the first one is for the definition of IDPs, and the second is for the sources of international protection to them.
