الهجرة الغير الشرعية بين التجريم وحقوق الإنسان

الملخص
أصبحت الهجرة الغير الشرعيّة ظاهرة عالمية تحاول كل الدول محاربتها والحد منها، نظرا للجرائم الناتجة عنها، خاصة الجرائم العابرة للحدود، كالاتجار بالبشر والمخدرات والاستغلال بمختلف أشكاله، والإرهاب الدولي. فالمهاجر الذي فرّ من جحيم الحروب والفقر والصراعات، يجد نفسه بين كماشة العصابات التي استثمرت في مآسيه، وكماشة الموت في الصحاري والبحار والسجن والاعتقال، لذا تسعى الدول للحد منها من خلال سنّ القوانين وعقد الاتفاقيّات، لكنّ هذه القوانين قد لا تخدم مصلحة المهاجر بقدر مصلحة الدول خاصة الدول الكبرى، وأمام الواجب الإنسانيّ اتجاه المهاجر وحقوقه المنصوص عليها في القوانين الدولية خاصة ميثاق حقوق الإنسان، والقوانين الداخلية للدول، نحاول دراسة الظاهرة من خلال الأسباب والنتائج وكيف عالجتها الدول و الهيئات العالمية من خلال الأطر القانونيّة، وبقدر دراسة الإطار التشريعيّ للظاهرة، بقدر تسليط الضوء على مدى اتجاه الإرادة الفعليّة لحماية هذا المهاجر. Illegal migration between criminalization and human rights Illegal immigration has become a global phenomenon that all countries are trying to combat and reduce because of the resulting crimes, especially transnational crimes such as trafficking in human beings, drugs and exploitation in various forms, and international terrorism. The migrants who fled the hell of war, poverty and conflict find themselves among the gangs that have invested in their tragedies, the death squads of deserts, the sea, the imprisonment and the arrest. Countries seek to limit them by enacting laws and agreements. However, these laws may not serve the interests of migrants. Especially the major countries, and the humanitarian duty towards the immigrant and his rights stipulated in international laws, especially the Charter of Human Rights, and the internal laws of countries, we try to study the phenomenon through the causes and results and how it was handled by States and global bodies through legal frameworks, The legislative framework of the phenomenon, in so far as it sheds light on the extent of the actual will to protect the migrant.
