حماية الطفولة بين الشريعة الإسلامية والتشريع الجزائري والمواثيق الدولية

الملخص
يعتبر الطفل النواة الأولى للمجتمع الصالح، المتعلم والمتسامح، فالاعتناء به هو اعتناء بمستقبل المجتمع وبأمنه واستقراره ورقيه وازدهاره. ولقد عملت الأمم المتحدة على إصدار صك قانوني يكون بمثابة المرجع الدولي في مجال الاهتمام بحقوق الطفولة وتعزيزها، فكانت "الاتفاقية الدولية لحقوق الطفل" النموذج الأمثل لذلك، حيث تمت المصادقة عليها من قِبل الجمعية العامة للأمم المتحدة بتاريخ: 20/11/1989م، ودخلت حيّز التنفيذ بتاريخ: 02/09/1990م. وإيمانا من الجزائر بأصالة حقوق الطفل ورسوخها في الرصيد الاجتماعي والأخلاقي للمجتمع الجزائري، بادرت إلى الانضمام لهذه الاتفاقية بموجب المرسوم الرئاسي 92-461 المؤرخ في: 19/12/1992م. وهذا البحث هو تسليط للضوء على الالتزامات الدولية للجزائر في مجال حقوق الطفل من خلال المطالب الآتية: - المطلب الأول: مفهوم الطفل في الشريعة الإسلامية والمواثيق الدولية. - المطلب الثاني: المبادئ العامة التي دعت إليها اتفاقية حقوق الطفل مقارنة بالتشريع الإسلامي. - المطلب الثالث: الحماية القانونية للطفولة في التشريع الجزائري. The protection of children in Islamic law and the Algerian legislation and international conventions The child is considered the heart of the best community, educated and tolerant, and when we take him necessary care, we preserve the future of society and its security and stability and advancement and prosperity. The United Nations has worked to issue legal instrument to serve as international reference in the area of concern for the rights of childhood and promotion, was the "International Convention on the Rights of the Child" optimal model for it, where it was approved by the United Nations General Assembly on 11.20.1989 AD, and entered into force on 09/02/1990 m. Algeria Believe authenticity Rights of the Child and ingrained in the social and moral balance of Algerian society, it took the initiative to join this Convention by Presidential Decree 92-461 dated 12/19/1992 m, This research try to answer about children's rights through the following demands: -First: the concept of a child in Islamic law and international covenants. -The second requirement: the general principles advocated by the Convention on the Rights of the Child compared to the Islamic legislation. -Third: the legal protection of childhood in the Algerian legislation.
