بدائل العقوبة السالبة للحرية قبل تنفيذ الحكم القضائي

الملخص
اتجهت السياسة الجنائية الحديثة نحو البحث عن بدائل للعقوبة السالبة للحرية، و هذا من أجل تحقيق أغراض العقوبة التي توصلت إليها، و المتمثلة أساسا في الإصلاح و الـتأهيل و إعادة الإدماج، و من بين هذه الأنظمة التي تبنتها مختلف التشريعات نتطرق إلى نظامين وهما: نظام وقف تنفيذ العقوبة، و نظام العمل للنفع العام ، حيث يتمثل النظام الأول في النطق بالعقوبة المقررة للجاني ولكن يتم توقيفها و تعليق تنفيذها على شروط يتمثل أهمها في الابتعاد عن الإجرام و عدم ارتكاب أي فع معاقب عليه قانونا خلال فترة زمنية محددة قانونا، أما نظام العمل للنفع العام فيتمثل أساسا في استبدال عقوبة الحبس بعقوبة أداء عمل لدى شخص معنوي في القانون العام و دون أجر لمدة زمنية مقدرة بالساعات من طرف القاضي في الحكم. و الهدف الأساسي من هذه الأنظمة هو تحقيق أغراض العقوبة. لكن خارج أسوار المؤسسة العقابية، و هذا لتفادي احتكاك المجرمين المبتدئين بمعتادي الإجرام من جهة، ومن جهة أخرى لتجنب ظاهرة اكتظاظ السجون و ما يترتب عنها من سلبيات. Modern penal policy has tended to seek alternatives to freedom-depriving pupunishment, in order to achieve the purposes of its punishment, which are mainly in the reform, rehabilitation and reintegration. Among these systems adopted by the various legislations we refer to two systems : suspension of sentence and work of general interest The first is to pronounce the penalty against the offender, but it is suspended on conditions, the most important of which is to stay away from the crime and not to commit any act punishable by law within a specified period of time.Community work consists mainly in commuting the penalty of imprisonment with the penalty of performing ? work for a legal personality in public law and without remuneration for an estimated period of hours by the judge in judgment. The primary purpose of these regulations is to achieve the purposes of punishment, but outside the walls of the penal institution, so as to avoid contact between debutant and repeat offenders, on one hand. on the other hand, it aims to avoid the phenomenon of overcrowdedness in prisons and the consequent disadvantages.
