نظرة في واقع التنظيم القانوني لدمج الميليشيات العراق كنموذج للدراسة

الملخص
نروم في هذه الدراسة التي تتعامل مع إلغاء أو دمج الميليشيات في العراق كتحليل دستوري، حيث تعتبر تطبيقاً للنص الوارد في المادة التاسعة من دستور جمهورية العراق لسنة 2005 في الفقرة (ب) من البند (أولا) منها والتي جاء فيها (يحظر تكوين ميليشيات عسكرية خارج إطار القوات المسلحة) وفي ضوء النصوص القانونية الواردة في الأمر رقم 91 لسنة 2004 تمنع القوات المسلحة والميليشيات، والمجموعات المسلحة من العمل داخل العراق باستثناء ما نص عليهم في هذا الأمر، ترينا هذه الدراسة المشاكل والصعوبات التي تتحدى عملية نزع السلاح للمجموعات المسلحة غير النظامية نتيجة الفراغ السياسي لعام 2003، هذه الدراسة تزود الحكومة الاتحادية والسلطة التشريعية في تحسين أدائهما، من خلال إجراءات أكثر جدية لنزع سلاح المجموعات المسلحة التي هي عملية طردية صعبة ومعقدة من حيث ارتباط نزع السلاح بتكامل الجيش العراقي. This study deals with the legal Regulating for Disbanding of militias in Iraq as a constitutional Analysis, Moreover, this study considers the application certainly for article (9)from of the Constitution of Iraq 2005 ,states that (First :B- The formation of military militias outside the framework of the armed forces is prohibited), In the light of the lawful articles in coalition provisional authority order number 91 on 2004 regulation of Armed Forces and Militias, and membership therein, are prohibited within Iraq, except as provided herein by order 91?. This study shows the problems and the difficulties which challenge the application of Disarming the militias or irregular armed groups, from the policy vacuum of 2003, Finally, the study provides a number of recommendations that may enhance the performance of the federal government & parliament, the most important of which is taking serious measures on the part of the government to the demilitarisation of Iraqi armed groups which has been a difficult and complex process, as it attempts to link demilitarisation with integration into the national army.
