الملخص

تعتبر الصفقات العمومية محورا هاما للتنمية المحلية وتطوير الاقتصاد الوطني الجزائري،ويتجلى ذلك من خلال الّنصوص القانونية الصادرة منذ 1962. وقد حاول المشرع الجزائري فيما يتعلق بعمليةِ إبرامِ الصفقات العمومية عن طريقِ طلب العروض مسايرةَ أهمِّ التطوّراتِ والتغييراتِ الحاصلَة على المستويَينِ (الوطني والدولي)، وذلك من خلالِ تكريسِ المحافَظة على المال العام، وفرضَ الرقابةِ على كل عملٍ من أعمالِ الإدارة تهدفُ من ورائهِ إلى صرفِ المال العامِّ خاصة في ظلِّ انخفاضِ أسعار البترول. تهدف هذه الورقة الى البحث في مدى مساهمة قوانين الصفقات العمومية في تحقيق حماية المال العام مع تسهيل إجراءات إبرام الصفقات العمومية لتشجيع المستثمرين المحليين والاجانب. وقد تم استعمال المنهج الوصفي،وتوصلت الدراسة الى أن المشرع الجزائري تدارك الثغرات الموجودة في القوانين السابقة المنظمة للصفقات العمومية. Public transactions are necessary for the local development and development of the Algerian national economy, this is reflected in the legal texts published since 1962.The Algerian legislator with regard to public procurement through the solicitation of tenders has tried to follow the most important developments and changes at the national and international levels, and this by devoting the preservation of public funds, and the imposition of control over each task of the administration aims to result in the disbursement of public money, especially in light of low oil prices. This article examines the contribution of public transaction laws to the protection of public funds, with the facilitation of procedures for concluding public operations to encourage domestic and foreign investors. The descriptive approach was used in the study, One of the most important results of the study is that the Algerian legislator was able to correct the flaws of previous laws.
