الملخص
يعتبر نظام حامي الحقوق المنشئ حديثا بموجب تعديل الدستور الفرنسي في سنة 2008، هيئة دستورية مستقلة عن بقية السلطات في الدولة، يتم تعيينه من طرف رئيس الجمهورية بعد موافقة غرفتي البرلمان، كما حظي بمجموعة من الضمانات حتى تضمن له استقلاليته، ويساعد حامي الحقوق في مهامه مجموعة من الأجهزة والمتمثلة في المجامع بالإضافة إلى إمكانية الاستعانة بمساعدين في ميادين معينة قصد تقديم الدعم اللازم له. ويتم إخطار حامي الحقوق من الشخص المتضرر مباشرة أو بطريق غير مباشر سواء من طرف الجمعيات المعنية وحتى من طرف رئيسي غرفتي البرلمان الفرنسي وأعضاء البرلمان الأوروبي، وقد أنيطت بحامي الحقوق ومساعديه العديد من الاختصاصات تتمحور بين حماية حقوق وحريات الأفراد البالغين والأطفال، كما يختص بمحاربة كل أشكال التمييز العنصري والسهر على احترام قواعد أخلاقيات مهنة الأمن، بالإضافة إلى توجيه وحماية المبلغين عن المخالفات، مما جعله يكتسب مكانة متميزة لدى المجتمع الفرنسي نظرا للدور الجوهري والهام الذي يقوم به. The Defender of Rights recently created under the revision of the French Constitution in 2008, is a constitutional authority independent of the rest of the State institutions. It is appointed by the President of the Republic after a favorable opinion of both Houses of Parliament. It has also benefited from a set of guarantees to ensure its independence and is assisted, in its missions, by a set of bodies being colleges, in addition to the possibility of being supported by other assistants from specific areas to provide it with the necessary support. The Defender of Rights is seized directly by the injured party or indirectly, either through the associations concerned or even by the presidents of the two Houses of the French Parliament and the members of the European Parliament. The Defender of Rights and its assistants are assigned various competences focused on protecting the rights and freedoms of adults and children. It is also responsible for combating all forms of discrimination and monitoring the respect of ethics in security professions, in addition to guide and protect the whistleblowers. All that has given it a distinguished place in French society, given the crucial and essential role it undertakes.
