الملخص
الملخص : يتمتع رئيس الجمهورية بصلاحيات وسلطات واسعة من بينها إصدار قرار العفو عن العقوبة ( العفو الرئاسي )، ولقد كرست جميع الدساتير التي عرفتها الدولة الجزائرية نظام العفو عن العقوبة واعتبرته حق أصيل لرئيس الجمهورية لا يخضع لأية قيود ولا أية رقابة ، إلا أن المشرع الجزائري لم يتناول النظام القانوني للعفو عن العقوبة عن طريق توضيح أسسه والقواعد التي يقوم عليها ، ولكن ما وجدناه من خلال اطلاعنا على بعض النصوص الخاصة انه تم التطرق ولو سطحيا إلى بعض الشروط والإجراءات الخاصة به والتي تمثل النظام القانوني لمنح العفو عن العقوبة . الكلمات المفتاحة : العفو الرئاسي ، سلطات رئيس الجمهورية ، العفو عن العقوبة . Abstract The President of the Republic has wide powers and powers, including the issuance of a pardon or pardon. All the constitutions adopted by the Algerian state have enshrined the amnesty system as a genuine right of the President of the Republic, subject to no restrictions or censorship, However, the Algerian legislator did not address the legal system of amnesty by clarifying its basis and the rules on which it is based, but what we found through our knowledge of some special texts was that it was even superficially addressed to certain conditions and procedures which represent the legal system for granting pardons. Résumé Le président de la République dispose de pouvoirs étendus, notamment d'une grâce ou d'un pardon.Toutes les constitutions adoptées par l'État algérien ont consacré le système d'amnistie en tant que droit véritable du président de la République, sans restrictions ni censure. . Cependant, le législateur algérien n'a pas abordé le système juridique d'amnistie en clarifiant son fondement et les règles sur lesquelles il repose, mais nous avons constaté, à la connaissance de certains textes spéciaux, qu'il était même superficiellement soumis à certaines conditions et procédures qui constituent le système juridique en matière d'octroi de grâce..
