الملخص
الملخص: إن الصعوبة الأساسية في موضوع الولاية على النفس والمال في مجال تنازع القوانين التي تخص، تكمن في كيفية الوصول إلى القانون الواجب التطبيق من بين القوانين المتنازعة، ومدى فعاليتها لتحقيق لمصلحة الطفل الذي يشكل المحور الأساسي في العلاقة، مما يتعين على القاضي أن يكون حريصا على الحكم طبقا لما يحقق هذه المصلحة ومن ثم الحماية. وعلى هذا الأساس نطرح الإشكال الآتي: ما مدى مراعاة المشرع الجزائري لحماية الطفل عند وضعه لقواعد الإسناد المرتبطة بالحضانة والولاية على المال؟ Résumé La principale difficulté en matière du conflit des lois concernant la tutelle tant sur la personne que sur les biens, réside dans la façon de déterminer la législation applicable parmi les législations litigieuses, et de ce fait, quelle est son effectivité quant à la réalisation de l’intérêt de l’enfant, lequel constitue le leitmotiv fondamental dans cette relation. D’où, le juge, quant à lui, sera tenu d’observer dans sa décision ledit intérêt, à savoir la protection de l’enfant. Sur cette base, nous exposons la problématique suivante : quelle est l’attention portée par le législateur algérien dans la protection de l’enfant lors de son adoption des règles de rattachement se rapportant au droit de garde et à la tutelle sur les biens ? Abstract The main difficulty in the conflict of laws concerning the supervision both on the person than on the property, lies in how to determine the legislation among the contentious legislation, and as a result, what is its effectiveness as to the realization of the interests of the child, which constitutes the fundamental leitmotif in this relationship. Hence, the judge, meanwhile, will be required to observe in its decision the said interest, namely the protection of the child. On this foundation, we subtract forms: what measures legislator Algerian to protect the children when positioned in the rules of imputation associate in the silver of nursery garden and the State?
