Police discretion is a controversial issue. Even though the law has laid down due process for the police to follow and requires them to carry out non-discretionary full enforcement ; in reality, that police exercise discretion is a commonly known fact. There are two broad areas where the police can and need to exercise discretion. Firstly, an officer has to decide whether or not to arrest an individual when such circumstances arise. Secondly, he has to make disposition decision against those who are arrested.
