المعالجة التشريعية للترقية العقارية في الجزائر

الملخص
الملخَّـص: مثّل ضبط نشاط الترقية العقارية وتنظيم مهنة المرقي العقاري؛ اهتماما متأخرا من طرف المشرع الجزائري، وتم التوجه إليه بهدف إضفاء تنظيم لهذا النوع من النشاط؛ وإحاطته بجملة من الضمانات، خصوصا مع اتساع نطاق العمران واحتياجاته التي تواكبت مع تزايد السكان، والدخول في نمط اقتصاد السوق، واتساع النشاط التجاري وقطاع الخدمات. زادت أهمية الترقية العقارية كنشاط متصل بالجانب العمراني والاقتصادي، من خلال كونه يفتح المجال أمام المساهمين العموميين والخواص، في انجاز سكنات وتمويلها، وخلق محيط تنافسي في تحسين مستوى السكنات وأسعارها. Résumé L'activité de la promotion immobilière et de l'organisation de la profession de Immobilier, était trop tard dans législation algérien, afin de donner à l'organisation de ce type d'activité , et des garanties pour le faire , en particulier avec l'expansion de l'urbanisation et de ses besoins, ce qui a coïncidé avec la croissance démographique, ainsi que l'entrée dans le style de l'économie marché et l'expansion du secteur des entreprises et les secteurs services. A cause de l'augmentation l'importance d'activité de promotion immobilière aspect lié du développement urbain et économique, l’Algérie découvre qu'il faut avoir une nouvelle vision sur ce domaine, en étant un champ ouvert a l'achèvement du logement et du financement, et de créer un environnement concurrentiel pour améliorer le niveau des constructions et des prix. Abstract : The control of the promotion of real estate and the organization of the real estate profession; marked by the late attention of the Algerian legislator, in order to give the organization of this type of activity, and guarantees to do so, and guarantees for doing so, especially with the expansion of urbanization and its needs, this coincided with population growth, as well as the entry into the style of the economy market and the expansion of the business sector and service sectors. The cause of the increase the importance of real estate promotion activity related aspect of urban and economic development, Algeria discovered that it is necessary to have a new vision in this area, being a field open to the completion of housing and financing, and to create a competitive environment to improve the level of constructions and prices.
