أثر تشريعات الاستهلاك على مبادئ النظرية التقليدية للعقد

الملخص
اتسمت النظرية العامة للعقد ولوقت طويل بالثبات والاستقرار، لكن مع بروز ظاهرة تشريعات الاستهلاك التي جاءت بمفاهيم وتقنيات جديدة أثرت على المبادئ الكلاسيكية للعقد، وهذا من أجل توفير حماية فعالة للمستهلك بسبب اختلال التوازن العقدي الذي يميز العلاقات الاستهلاكية، الأمر الذي جعل الفقه يتساءل عن مستقبل القانون المدني في ظل انتشار تشريعات الاستهلاك، ولذا يجب إصلاح القانون المدني حتى يستمر تنصيبه على أنه قانون الشريعة العامة بالنسبة للقواعد القانونية الأخرى. The general theory of contract has been characterized- for a long time-by constancy and stability. but with the emergence of the consumption legislation sphenomenon new concepts and techniques have been broughtandimpacted classical principals of contract,those legislations purpose was to provideeffective protection for the consumer from the contract imbalance that characterizes the consumption relations, and this made the scholarswonder about the Civil law future with the spread of consumption legislations. Therefore, the Civil law should be reformed in order to continue as the basis of other private law rules.
