التطوّرات القضائية لتراجع الخطإ الجسيم في مسؤولية مصالح الأمن(دراسة مقارنة بين القضاء الجزائري والفرنسي)

الملخص
تتناول هذه الدراسة التطوّرات التي شهدها القضاء الإداري في مسؤولية المصالح الأمنية، وتبحث بالضبط في مسألة التخلّي عنالخطإ الجسيم في هذه المادة وما تثيره من إشكالات قانونية، وكيف تعامل القضاء الإداري مع ذلك؛ حيث كان يشترط أوّل الأمر وقوع خطإ جسيم لترتيب المسؤولية، لكن سرعان ما بدأ يتراجع شيئا فشيئا لصالح الخطإ البسيط أو المخاطر، آخذا في الاعتبار طبيعة النشاط وظروف استعمال السّلاح، إلى غاية أن تخلّى نهائيا عن الخطإ الجسيم في مطلع القرن الحالي. وإن كان القضاء الفرنسي شهد هذه التطوّرات وفقا لسياسته الاجتهادية في تقدير النشاطات الأمنية، فإنّ القضاء الجزائري وإن اشترط في البداية كأصل عام الخطأ الجسيم إلى جانب مخاطر السّلاح، ثمّ استعمل أسسا مختلفة مراعاة لتعدّد وضعيات مصالح الأمن أو الضحية، إلاّ أنّه انتهى على ما يبدو إلى تأسيس المسؤولية على مخاطر السّلاح مقابل الخطإ البسيط في التدابير الأمنية القانونية دون التعرّض للجسامة في النشاط المادي This study examines the evolutions of the administrative jurisprudence of the responsibilityofthe policeservices, searches exactly the question of the abandonment of heavy fault in this matter and raised legal confusions, and the way of treating administrative jurisprudence with these confusions; where it was to require with the first occurrence of a heavy fault to engage the responsibility, but soon it started to move back gradually with the profit of simple fault or risk, by taking account of the nature of the activity and the circumstances of the use of the weapons, until once and for all giving up heavy fault at the beginning of this century. Although French jurisprudence saw these developments in accordance with its jurisprudential policy in the estimate of the activity of police, Algerian jurisprudence, if it firstly required like a general principle a heavy fault as well as the risks of the weapon, then it used bases different by taking account the multiplicity from the positions of the police service or the victim, but it finished on what seems to establish the responsibility on the risk for weapon opposite the simple fault for the legal steps of police without exposure to gravity for the materials activities
