دور التوقيع الالكتروني في تأمين العمليات المصرفية في التشريع الجزائري

الملخص
إن إتاحة استخدام التوقيع الإلكتروني تدعم التحول إلى عالم لا ورقى، يأمن فيه كل متعامل على أمواله ومصالحه، كما أن التوسع في استخدام التوقيع الإلكتروني يرفع كفاءة العمل الإداري ويساعد على الارتقاء بمستوى أداء الخدمات الحكومية بما يتفق مع إيقاع العصر، ومن شأنه أن يضيف إلى المزايا التنافسية في ظل النظام التجاري العالمي الجديد والذي أصبحت المعاملات الإلكترونية سمة من سماته وعلامة دالة عليه و من أهم مجالات استخدام التوقيع الإلكتروني في مجال العمليات المصرفية لتامين وسائل الدفع الالكترونية، اصدر المشرع الجزائري قانون رقم 15/04 المتعلق بالتوقيع والتصديق الالكترونيين، لزيادة الثقة في التعامل بهذه الوسائل وبالتالي، هل يمكن الوثوق والأمان في المعاملات الإلكترونية عامة ووسائل الدفع خاصة؟ وهل البنوك الوطنية اتجهت نحو عصرنة خدماتها المصرفية لدخول المنافسة في مجال المعاملات الالكترونية؟ .، The use of e-signature insures the transition to a non-paper world in which all transactions parties’ money and interests are safe. The wider use of electronic signature increases the efficiency of administrative work and helps to improve the performance of government services in accordance with the pace of the modern age; in addition, it should add to the competitive advantages under the new global trading system, in which electronic transactions have become a prominent feature and a sign of its existence. One of the most important areas of electronic signature use is undoubtedly in the field of banking; with the aim of securing means of electronic payment. The Algerian legislator issued the law (Act) No. 15/04 on the electronic signing, to increase confidence in dealing with these means. Therefore, can we feel safe and trust the electronic transactions, generally, and the payment methods, particularly? And have national banks moved towards modernizing their banking services in order to enter the world of competition in the field of electronic transactions?
