الأوراق الموقعـة علـى بيـاض وحجيتهـا فـي الإثبـات

الملخص
تعتبر الكتابة من الأدلة ذات القوة المطلقة في الإثبات، و هي إما كتابة رسمية أو عرفية، و من صور الورقة العرفية التوقيع على بياض حيث يقوم المدين بالتوقيع، أما الكتابة فيقوم بها الدائن وفقا للاتفاق الحاصل بينهما و في هذه الحالة تكون للورقة حجيتها على الكافة. أما لو خان الدائن الثقة و الأمانة و ملأ هذه الورقة الموقعة على بياض ببيانات غير متفق عليها عد مرتكبا لجريمة خيانة الأمانة، و تسري حجية هذه الورقة على موقعها في مواجهة الغير حسن النية. أما لو تم الحصول على هذه الورقة الموقعة على بياض بطريقة غير مشروعة، فيكون من تحصل عليها بهذه الطريقة مرتكبا لجريمة التزوير، و تفقد هذه الورقة حجيتها في الإثبات بالنسبة للجميع و تصبح باطلة. Si le document « Blanc seing » a été obtenu par voies illégales, le propriétaire sera passible de crime de fraude en écriture privée, et le document perdras sa force probante devant tous et devient nul.
