الحقوق البيئية بين المضمون الموضوعي والإجرائي

الملخص
يعالج هذا الموضوع الحقوق البيئية من المنظور الموضوعي والإجرائي، فالدفاع عن حق كل فرد في التمتع ببيئة سليمة، يتوقف من الناحية العملية، وبالنظر لخصوصية هذا المفهوم ومضامينه الأساسية، على ضرورة توافر مجموعة من الآليات، أو بالأحرى الضمانات القانونية الكفيلة بتحقيق ذلك، اعتباراً لخصوصية فكرة الحق في البيئة، وإنفراده بطابعه الإجرائي عن باقي منظومة حقوق الإنسان الأخرى، إذ لا يمكن افتراض تحرك الأفراد والجماعات للدفاع عن حقها في بيئة سليمة، من دون أن يكون لهم القدر الكافي من العلم بخصوصيات ومعطيات هذه الأخيرة، وما ينطوي عليها من مشاكل ومخاطر، و تمكينهم بناءً على ذلك– العلم المسبق- من المشاركة والمساهمة بخبراتهم ومداركهم في بلورة القرارات والتدابير المتعلقة بها، مع الحرص على تمكينهم الفعلي من هاته الأطر والإجراءات، وضمان تمتعهم الفعلي بها، من خلال صلاحياتهم لمعارضة أي مساس أو انتهاك لها، وبمختلف صور الطعن المحدّدة قانوناً، الإدارية منها والقضائية. The issue of environmental rights is adressed from a substantive and procedural perspective, defending the right to a sound environment, depends in practice - given the specificity of this concept and it's basic contents- on a range of mechanisms or rather the legal guarantees to achieve it. the specificity of the idea of the right to environment and it's procedural character sets it apart from the other human rights , as it can not be assumed individuals and groups will move to defend their right to a healthy environment, without having the adequate knowledge of this right specificities and the the problems and risks involved , and enabling them accordingly to participate and contribute with their expertise and knowledge in shaping the decisions and measures relating thereto, while ensuring that they are effectively empowered by these frameworks and procedures ; and ensuring its actual enjoyment, through their powers to oppose any prejudice or violation there of , and that withing the various forms of legal ,administrative , and judicial appeal.
