التحولات السياسية في المنطقة العربية ومسألة التعديلات الدستورية: قراءة في التعديل الدستوري الجزائري الجديد

الملخص
ليس ثمة شك في أن هناك حاجة جدية ملحة في سائر أرجاء الوطن العربي لتحرك القوى المعنية بالإصلاح بأوسع معانيه وأشملها، من أجل تفعيل التوجهات الديمقراطية وترشيد الحياة السياسية، وبخاصة القوى المتضررة أكثر من غيرها من الأوضاع المأزومة الراهنة سياسيا واقتصاديا واجتماعيا وثقافيا، وبعد الجدل الذي شهدته المنطقة العربية على امتداد السنوات الأخيرة والذي ما يزال ممتدا وسيستمر إلى فترة أخرى قادمة، حول الضغوطات والمطالب الشعبية المتزايدة والمتعلقة بالإصلاح في دول المنطقة، قد عبر عن إدراك عربي عميق بأهمية وضرورة وإلحاحية القيام بعمليات إصلاح شاملة أخذ الإصلاح الدستوري أولويات الإصلاح السياسي في معظم الأنظمة العربية. فالدستور هو القانون الأعلى للدولة والمجتمع، وبصفته هذه فهو الذي ينظم العلاقات القانونية التي تقوم عليها الدولة وجميع مؤسساتها وأجهزتها وكذلك الهيئات المدنية، ويحدد أيضا صلاحيات وواجبات جميع مستويات السلطة والحكم وكيفية تشكيلها وتحديدها، وهو ما تفتقده الدساتير العربية ما يفرض ضرورة تفعيلها وترشيدها بإحداث الإصلاحات والتعديلات اللازمة عليها. It is doubtless that there is an urgent need for serious renovation in the Arab countries in order to activate the democratic trends and rationalization of political life, especially the powers affected more than others because of the critical political, economical, social, and cultural status quo. The controversy that the Arab region has witnessed over recent years and which is still taking place and will continue in the future about the pressures and the demands of the popularity concerning the reformation in the countries of the region, has expressed a deep Arab awareness to carry out a comprehensive reforms, principally the constitutional political reform in most of the Arab regimes. The Constitution is the supreme law of the state and society which regulates legal relations upon which the state and all its institutions as well as civil bodies stand. It also defines and sets up the powers and duties of all levels of authority and governance, most of which the Arab constitutions lack. Subsequently, the necessity of activating and rationalizing the creation of the necessary reforms and adjustments is strongly required.
