اتفاقية حقوق الملكية الفكرية ) Trips (، تأثيرها على الاقتصاد العربي واتجاه العلاقات التجارية )الأردنية – الأمريكية

الملخص
إن الابداع والتجديد بواسطة التكنولوجيا والذكاء الإداري يشكلان العصب الرئيسي للنمو الاقتصادي في عصرنا الحديث. ولقد تم إدراج موضوع حماية حقوق الملكية الفكرية في مفاوضات الاورغواي بناء على طلب الإدارة الامريكية. وتشمل حقوق الملكية الفكرية حسب بنود الاتفاق: حقوق الطبع والعلامات التجارية والجغرافية للسلع، والتصميمات الصناعية، وتصميمات الدوائر المتكاملة، والأسرار الصناعية. وتهدف الاتفاقية إلى تعميم الحماية على كل ما يرتبط بالملكية الفكرية المتعلقة بالتجارة، ووضع القواعد الجديدة لحماية هذه الحقوق، وتنظيم الآليات التي تتولى تطبيق الحماية لمنع حدوث المنازعات وتسويتها. كما اهتمت بالتخطيط لحماية الصناعات ذات التقنية العالمية، كالصناعات البيولوجيا وما تشمله من هندسة جينية وحماية صناعة الأدوية. ولقد توجهت الدول الصناعية لتحقيق طموحاتها من خلال هذه الاتفاقية التي ترسخ الرقابة الفعالة لحقوق الملكية الفكرية، عكس الاتفاقات السابقة. إن مجمل الاتفاقية تقف وراء صياغتها الدول الصناعية المتقدمة، وتفرضها على دول الجنوب والدول العربية باعتبارها مخزن المعرفة والتكنولوجيا. سواء ما يتصل بالموارد البشرية، الاقتصادية، المالية، والمؤسساتية. ويتعاظم عبء هذه الاتفاقية في تطويق الدول العربية وإعادتها إلى اقتصاد تصدير المواد الأولية وسوق لتصريف منتجاتها. The creativity and innovation by technology and administrative intelligence constitute the backbone of economic growth in the modern era. The inclusion of the issue relative to the intellectual property rights protection in the Uruguay negotiations was made on the request of the US administration. According to the terms of the agreement, the intellectual property rights include: copyright, trademarks, geographical commodities rights, industrial designs, layout designs of integrated circuits, and industrial secrets. The agreement aims to extend protection for all associated intellectual property related to trade, and to develop new rules to protect those rights, and organizing mechanisms to enforce protection for conflict prevention and resolution. It also focuses on planning for the protection of global technology industries such as the biological process which includes the genetics engineering and the protection of the pharmaceutical industry. Unlike previous agreements, the industrialized countries went through this agreement to achieve their aims concerning the effective control of the intellectual property rights. The advanced industrial nations, acting as a provider of knowledge and technology, were the designers of the entire agreement. They made every endeavor to enforce it to the Southern countries and the Arab states. The burden of this agreement will deepen in the encirclement of the Arab states, maintaining them as exclusive exporters of raw materials, and provision of a market for their advanced products.
