حرية إنشاء الجمعيات في القانون الجزائري

الملخص

تعتبر الجمعيات جزء من المجتمع المدني، والعنصر الحيوي في المجتمع المتحضر وهمزة وصل بين الدولة والمواطن، فضاء للتطوع والمساهمة في التنمية وبناء الحس المدني، تكريسا للممارسة الديمقراطية لضمان الحقوق والحريات الفردية والجماعية و هذا ما عبرت عنه الاتفاقيات الدولية المختلفة لحقوق الإنسان، بداية من الإعلان العالمي لحقوق الإنسان لعام 1948 في مادته ) 20 ( ، كما تم إقراره من خلال المادة ) 22 ( من العهد الدولي للحقوق المدنية و السياسية لعام 1966 ، أما على المستوى الإقليمي فقد جسدت الاتفاقية الأوربية لحقوق الإنسان ذلك في مادتها ) 11 (، و كذلك الحال بالنسبة للاتفاقية الأمريكية لحقوق الإنسان في مادتها ) 16 (، كما كفل الميثاق الإفريقي لحقوق الإنسان والشعوب ذلك في مادته ) 10 (، بالإضافة إلى الميثاق العربي لحقوق الإنسان لعام 2004 في مادته ) 24 (، وجسدته الدساتير الجزائرية المتعاقبة والقوانين أهمها الأمر رقم 71 / 79 و القانون رقم 87 / 15 ثم صدر بعد ذلك القانون رقم 90 / 31 في ظل دستور 1989 ، أما دستور 1996 فقد تعرض في أكثر من مادة لحرية إنشاء الجمعيات من خلال المادة 41 التي أكدت على أن حريات التعبير، و إنشاء الجمعيات و الاجتماع مضمونة للمواطن، كما أقرت المادة 43 أن حق إنشاء الجمعيات مضمون، وتشجع الدولة ازدهار الحركة الجمعوية وتركت المادة شروط و كيفيات إنشاء الجمعيات لقانون الجمعيات الجديد 12 / 06 . Associations are part of the civil society, a vital element in a civilized society and a link between the state and the citizen, a space to volunteering and contributing to the development and construction of civil spirit, a consecration of the practice of democracy to ensure individual and collective rights and freedoms. This is what was expressed by the different international conventions on human rights. Starting from the Universal Declaration of Human Rights of 1948, in article (20), which has been approved by Article 22 of the International Covenant on Civil and Political Rights of 1966, the European Convention on Human Rights in its article (11), and so does the American Convention on human rights in its article (16), and ensured in the African Charter on human and people’s rights in article (10), in addition to the Arab Charter on human rights of 2004 in article (24), and it was embodied in the successive Algerian constitutions and laws such as: Order No. 71/79 and Law No. 87/15 and then released after that Law No. 90/31 under the 1989 Constitution. The 1996 Constitution has been exposed to freedom of association through Article 41, which confirmed freedom of expression and guaranteed the establishment of associations and meetings to the citizen. Foe example, Article 43 has guaranteed the right to form associations and the state encourages the development of associative movement while the conditions and modalities of the establishment of associations was left for the new law of associations 12/06.
