دور الإعلان العالمي لحقوق الإنسان في تدويل حماية الشخصية الانسانية

الملخص
ظلت قضية حقوق الإنسان لصيقة بسيادة الدول بحجة أنها علاقة بين الدولة ومواطنيها وان انتهاك الحقوق قد يمس بالسلم والأمن الداخليين فقط ومن ثم فلا يجوز للقانون الدولي أن يهتم بها. وبعد أن ثبت أن انتهاك الحقوق في دولة ما يمس بالسلم والأمن الدوليين، أصبح من الواضح أن على جميع الدول احترام قواعد حقوق الإنسان وحرياته الأساسية. باعتبارها واجبات داخلية والتزامات دولية. إنّ التطور الأسرع للقانون الدولي لحقوق الإنسان كان منذ اعتماد الجمعية العامة لمنظمة الأمم المتحدة للإعلان العالمي لحقوق الإنسان في 10 ديسمبر 1948، حيث أن الإعلان هو نقطة الانطلاق في هذا التطور و الاهتمام سواء من خلال إصدار اتفاقيات ومواثيق تلتزم الدول بتطبيقها، أو من خلال الآليات والأجهزة المتنوعة التي تعنى بتطبيق حقوق الإنسان على ارض الواقع. The issue of human rights has been linked to the sovereignty of States on the pretext that it is a relationship between the State and its citizens and that the violation of rights may affect only internal peace and security, and therefore international law may not take care of it. After it has been established that the violation of rights in a State affects international peace and security, it has become clear that all States must respect the norms of human rights and fundamental freedoms. As internal duties and international obligations. The most rapid development of international human rights law has been since the adoption of the Universal Declaration of Human Rights by the General Assembly of the United Nations on December 10, 1948, as the declaration is the starting point for this development and attention both by issuing Conventions and charters that States are obligated to apply, or through various mechanisms and instruments that deal with the application of human rights on the ground.
