لقد وضع الأمر رقم 07-01 المؤرخ في 1 مارس 2007 و المتعلق بحالات التنافي و الالتزامات الخاصة ببعض المناصب و الوظائف أحكاما جديدة. لقد جاءت هذه الأحكام بنوعين من الالتزامات، التزامات قطعية تمنع هذه الفئة من الموظفين من ممارسة بعض الأعمال أثناء تواجدهم في هذه المناصب، و التزامات مؤقتة يمتنع الموظف بمقتضاها من ممارسة بعض الأعمال عند مغادرته للوظيفة بعد أجل محدد، و هي الالتزامات التي يقتضي البحث تبيانها.
