انتهاء الوكالة وحدود سلطة الموكل في إنهائها في الشريعة والقانون

الملخص

ملخص: إن الوكالة هي من العقود المهمة التي شاع استعمالها بين الناس في تعاملاتهم اليومية، فهي وسيلة شرعية وقانونية، ذات أهمية اجتماعية واقعية، فهي تساعد الناس على تسهيل قضاء حوائجهم وتعاملاتهم المادية وغير المادية، كالبيع والشراء، والإجارة، والزواج، والطلاق، وقضاء الديون، والحج، والخصومات، وغيرها، وذلك من خلال التفويض الذي يمنحه الموكل للوكيل للتصرف باسمه ولحسابه في أمواله أو معاملاته، والقيام ببعض الأعمال التي يعود آثارها القانوني على ذمة الموكل. إن حرية الموكل في اختيار الوكيل الذي يضع فيه ثقته ليقوم مقامه ويعمل لحسابه، تقابلها من جهة أخرى سلطة قانونية ممنوحة للموكل في سحب هذه الثقة من الوكيل متى شاء، وبمناسبة أو بغير مناسبة، وسواء رضي الوكيل أم لم يرض بإنهائها. إلا أن هذه السلطة الممنوحة للموكل في إنهاء عقد الوكالة بإرادته المنفردة إن تُركت مطلقة بلا قيد ولا شرط ألا تضر بمصلحة الوكيل أو الغير، ونكون حينها أمام تنازع قضائي؟. إن هذا المبدأ الذي يمنح للموكل السلطة المطلقة في إنهاء الوكالة بالإرادة الانفرادية يتنافى في ظاهره مع مبدأ العقد شريعة المتعاقدين.( ) فما هي القواعد العامة التي تنتهي بها الوكالة؟ وما هو نطاق سلطة الموكل في إنهاء عقد الوكالة؟ وإلى أي حد تنتهي هذه السلطة الانفرادية للموكل في عزل الوكيل؟ وما هي الآثار القانونية المترتبة عليها؟ وما هي الحماية القانونية للوكيل أو الغير ضد تصرفات الموكل التي تتجاوز حدود سلطته؟ الهدف من هذا البحث هو الكشف عن الحالات الاستثنائية للمبادئ العامة التي تنتهي بها الوكالة، والتي تجعل سلطة الموكل في عزل وكيله مقيدة بما تراعي مصلحة الوكيل أو الغير الأجنبي، وكيفية حماية التصرفات القانونية من أي تجاوز في حق الوكيل أو الغير. هذه الدراسة المقارنة بين الفقه الإسلامي والقانون الوضعي، تبحث عن الإجابة لهذه التساؤلات المطروحة في الأسباب المختلفة لانتهاء عقد الوكالة، والحدود المقيدة لسلطان الموكل في إنهائها بإرادته الانفرادية، والآثار المترتبة على التصرفات الناتجة عن تجاوز هذه الحدود. Abstract: The Agency is one of the important contracts that are popular among people in their daily dealings. It is a legitimate and legal means of social importance. It helps people to facilitate their needs and transactions, such as selling and buying, leasing, marriage, divorce, debt settlement, Hajj , Discounts, etc., through the authorization given by the agent to the agent to act on his behalf and to calculate it in his money or transactions, and to do some of the work whose legal effects are on the client's behalf. The client's freedom to choose the agent in which he puts his trust to take his place and work for his account, corresponding on the other hand legal authority granted to the client to withdraw this confidence from the agent whenever he wishes, on occasion or not appropriate, whether or not the agent pleased to terminate. However, this authority granted to the client to terminate the contract of the Agency with his own will, if left unconditionally and unconditionally not detrimental to the interests of the agent or third parties, and then be in front of a judicial dispute. This principle, which gives the client absolute power to terminate the Agency by unilateral will, appears to be contrary to the principle of the contract of contract law. What is the scope of the client's authority to terminate the agency contract? To what extent does this unilateral power of the client terminate the agent? What are the legal implications? What is the legal protection of the agent or third party against the actions of the client beyond the limits of his authority? The aim of this research is to disclose the exceptional cases of the general principles that the agency ends, which make the authority of the agent to isolate his agent restricted to take into account the interest of the foreign agent or third party, and how to protect the legal acts from any violation of the right of the agent or third parties. This comparative study between Islamic jurisprudence and positivist law seeks to answer these questions in the various reasons for the termination of the Agency's contract, the restrictive limits on the authority of the client in ending it with his own unilateral will, and the consequences of the actions resulting from exceeding these limits.
