الآراء السياسية للإمام مالك من خلال كتاب الموطأ

الملخص
الملخص: في هذا المقل تتبع لكتاب الموطأ وحاولت أن أستخرج منه المواقف السياسية لإمام مالك بن أنس ، التي تبين كيف كان يتعامل بها الإمام مالك مع المؤسسة الحاكمة .وقد قسمت هذا البحث إلى مبحثين. المبحث الأول بينت فيه شخصية الإمام مالك ودورها في بلورة مواقفه السياسية ،من خلال منهجه الذي يقوم على التواضع العلمي وترك التعصب للرأي ، بالإضافة إلى تتلمذ أكبر رموز المدارس الفقهية كالمدرسة الشافعية متمثلة في الإمام الشافعي والحنفية متمثلة في الإمام محمد بن الحسن الشيباني ، بالإضافة إلى تبنيه منهج هدفه تجميع الأمة مع مراعاة عناصر الاختلاف بينها ، ودفاعه عن الحرية وإبداء الرأي بالطرق الشرعية ، أما المبحث الثاني فبينت فيه ملامح المنهج السياسي للإمام مالك فوجدته رحمه الله يوافق الخلفاء والحكام ويدعم آرائهم بكل وضوح فيما يوافق منهجه واجتهاده دوم مراوغة سياسية ودعمت ذلك بالكثير من الأمثلة ، كما أن من معالم منهجه أنه يخالف الحكام في بعض اجتهاداتهم وإعلان ذلك ، ودعمت هذا المنهج بالعديد من الأمثلة التي تبين ذلك وخلصت في نهاية المقال أن العلاقة التي كانت تربط العلماء بالحكام كانت علاقة تعاون في بيان الحق وتحقيق المصالح . Political opinions of Imam MALIK through the book “MUWATTA” Professor: DELHOUM LAKHDAR In this article from “EL MUWATTA” book, I tried to extract from it the political positions of Imam Malik IBN ANAS which shows how this Imam was dealing with the ruling establishment. I have divided this research into two sections. In the first section, I showed the character of Imam Malik and its role in shaping his political positions through his method which is based on scientific humility and on the leaving the intolerance of opinion. In addition to that, the biggest symbols of Jurisprudential schools such as the SHAFII School represented by the Imam SHAFII and the Hanafi School represented in the Imam Muhammad Ibn Al-Hasan Al-SHAIBANI have all been disciples of Imam Malik. Moreover, the Imam adopted the approach aiming at compiling the nation, taking into account the differences between them (The schools mentioned above) and his defence of the freedom of speech in a legitimate ways. In the second part, I stated the political approach of Imam Malik – GOD bless him- and I found it in accordance with the caliphs and the rulers as it very clearly supports their views in his approach without any political tricks. I also supported so many of the examples. Besides, the Imam’s approach was sometimes contradictory to the rulers’ in some of their reasoning and made that clear for all. I also supported this with many examples which show this Imam’s conduct in this context. I concluded the article by showing that the relationship between the scientists and the rulers was a cooperative relationship through the showing the truth and achieving the nation’s interests.
