المركز القانوني للمحافظ العقاري في ظل التبعية للوصاية الإدارية والخضوع للسلطة الرئاسية

الملخص
المحافظ العقاري في الجزائر هو موظف عمومي خاضع لوصاية وزارة المالية، وهو بذلك يخضع للسلطة الرئاسية لوزير المالية و المدير الولائي للحفظ العقاري، دون أن نهمل السلطات الممنوحة لكل من والي الولاية و المدير الولائي لأملاك الدولة، و في المقابل هو مطالب بضمان حماية الملكية العقارية في ظل انتهاج المشرع الجزائري لنظام الشهر العيني. المحافظ العقاري هو موظف ذو طبيعة خاصة، فهو لا يخضع للسلطة الرئاسية لرؤسائه بشكل مطلق، و هذا راجع لطبيعة الصلاحيات و المهام الموكلة إليه، و رغم هذا فإن الواقع أثبت تعرضه للعديد من الضغوطات تحول دون ممارسة مهامه بحيادية. The landed Property Registrar in Algeria is a public employee who works under the tutelage of the Ministry of Finance, thus he functions under the presidential authority of the Minister of Finance and the director of wilaya land conservation, and taking into consideration the authorities of the wali and of the director of the national domain, the landed property registrar is obliged to protect the real estate property respecting in that the Algerian legislations. Landed Property Registrar is an employee of a particular nature, as he is not absolutely subject to the presidential authority of his superiors because of the nature of the responsibilities assigned to him; whoever the reality shows that he is a subject of pressures that prevent him to do his duties neutrally.
