انبناء الشرائع الإلهية على العوائد الكونية والهيئات البشرية: قراءة في فكر الإمام الشاطبي

الملخص
ملخص: يعالج هذا المقال العلاقة بين النظام الكوني والنظام البشري وغاية ومقاصد الشرائع الإلهية عموما والإسلامية خصوصا ودورها في هذه العلاقة التفاعلية بين النظامين عند الإمام الشاطبي. ويتَعَرّضُ أيضا لقطعية واستقرار واستمرارية النواميس الكونية التي يصطلح عليها بمجاري العادات أو العوائد الكونية والانسجام والتوافق العام بين الأحكام الشرعية والنواميس الكونية. كما يتعرّضُ أيضا للتوافق والانسجام بين النظام البشري أو ما يصطلح عليه بالهيئة البشرية أو الخلقة أو الفطرة مع تحقيق وتأصيل الفرق بين ما هو دائم ومستمرّ استمرار أحوال الوجود وما هو مُتَغَيّرٌ لعدم رجوعه إلى قواعد كلية أبدية. Abstract: This article deals with the epistemological question of the relationship between the cosmic order and the human order in Abu Ishāqash-Shātibi and the relationship of these cosmic laws with the religious laws and their aims and aims in this inter-active relationship. He insists first on the certain, irrefutable and undeniable character of cosmic laws. It also evokes the perfect harmony between religious laws and human nature created according to an original nature called "Fitra" distinguishing between what is immutable and what is subject to temporal change and evolution. Résumé : Notre présent article traite de la question épistémologique du rapport entre l’ordre cosmique et l’ordre humain chez Abû Ishâqash-Shâtibî et le rapport de ces lois cosmiques avec les lois religieuses et leurs finalités et visées dans cette relation inter-active. Il insiste d’abord sur le caractère certain, irréfutable et indéniable des lois cosmiques. Il évoque aussi la parfaite harmonie entre les lois religieuses et la nature humaine créée selon une nature originelle dite « Fitra » en distinguant entre ce qui est immuable et ce qui est soumis au changement temporel et à l’évolution.
