مكانة الحق في البيئة ضمن حقوق الإنسان

الملخص
الملخص لقد عرفت الفترة الأخيرة ظهور جيل الحقوق التضامنية كالحق في السلام والحق في الإعلام والحق في التنمية، والحق في الاستخدامات التكنولوجية ، والحق في البيئة، ولعل هذا الأخير له صلة وطيدة بحقوق الإنسان المختلفة، وهو حق حديث النشأة وخاصة فيما يتعلق بالقواعد الكفيلة بتوفير الحماية اللازمة للبيئة، ونظرا لأهمية هذا الحق أصبحت له مكانة ضمن حقوق الإنسان. وللحق في البيئة مصادره وخصائصه و له ذاتيته وخصوصيته، فهو حق فردي وحق جماعي، كما أنه حق مركب، وهو حق مستقبلي واحتمالي أي أنه من الحقوق الزمنية، وبالنسبة للطبيعة القانونية لهذا الحق و علاقته بحقوق الإنسان، فهي في الأصل علاقة تكاملية إلا أنه يظهر بعض التعارض الظاهري مع عدة أنواع من هذه الحقوق إلا أن هذه الملابسات و التعارض سرعان ما تزول ويتضح التوافق في جميع الأجيال بدء بعلاقة الحق البيئي بالحقوق المدنية والسياسية، ثم علاقة الحق البيئي بالحقوق الاقتصادية والاجتماعية والثقافية، وأخيرا علاقة الحق في البيئة بالحقوق التضامنية.Summary The recent period has seen the emergence of a generation of solidarity rights, such as the right to peace, the right to information and the right to development, the right to technological uses and the right to the environment. The latter may have a strong connection to various human rights, , And given the importance of this right has become a human rights status. The right to the environment has its own resources and characteristics. It has an individual right and a collective right. It is a complex right. It is a right of future and potential, that is to say, a temporal right. As for the legal nature of this right and its relationship to human rights, The apparent conflict with several types of these rights, however, these circumstances and conflict soon disappear and the consensus is evident in all generations beginning with the relationship of the environmental right to civil and political rights, then the relationship of the environmental right to economic, social and cultural rights and finally the relationship of the right to the environment with the solidarity rights.
