ضوابط العمل بالقول الشاذ في الفتوى

الملخص
الملخص: من أهم المواضيع التي ينبغي الاهتمام بها، موضوع الفتوى، فكل الناس بحاجة ماسَّة إليها، ونظرًا لطروء مستجدات جديدة، وتغير أحوال الناس عمّا كان عليه من سلف، جاء هذا البحث ليبحث في قضية مدى إمكانية الفتوى بالأقوال الشاذَة والضعيفة، وترك مقابلها من الأقوال الراجحة أو المشهورة، وقد عولج هذا الموضوع من خلال ثلاثة مباحث: كان الأول منها للتعريف بمصطلحي الشاذ والفتوى، وثانيهما لأقوال أهل العلم في العمل بالراجح وترك الشاذ، وثالثها لذكر ضوابط العمل بالقول الشاذ، وبعض التطبيقات لذلك، ثم ختاما بذكر أهم النتائج. Summary Among the subjects for that importance should be given, the subject of the Fatwa, because all the people have it need. Since there is any developments, and the changing conditions of the people of what it was the predecessors, this study comes to searches in the matter of the possibility of the Fatwa with an irregulars and a weak says, and neglect the preponderant or celebrate opinions, this subject has been dealt with through the three sections: the first is devoted to define an irregular and Fatwa’s terms, the second to expose a scholars opinions on the use of preponderant and avoid using irregulars says, and the thirds to describe criterias or conditions which must be taken to use irregulars says and any applications where using it, and we finish with the quote of an important results.
