الملخص
الملخص: تحاول هذه الدراسة كشف جانب من التراث الفقهي الذي خلّفته المدرسة الأندلسية. وما شخص الإمام ابن عبد البر، إلاّ نموذج تمثيلي ودليل عملي على النضج العلمي والتميّز المنهجي لرجالات المدرسة الفقهية المالكية الأندلسية. و إيمانا مني بضرورة إحياء روح التدليل و التعليل التي كان يتسم بها الفقه الإسلامي المالكي، لما أصبح يساور المتعلمين من افتقار المذهب المالكي للدليل، و اعتماده على الرأي و النقول عن الأئمة و الشيوخ. .. آثرت أن أشارك بسهمي ـ و لو بقسط ضئيل ـ في بعث هذا المذهب و ترسيخ جذوره . فبدراسة " منهج الإمام ابن عبد البر في الاستدلال الفقهي " سيتبيّن أن ابن عبد البر، كان و سيظلّ عالما شامخا يعتزّ به المذهب المالكي خصوصا، و الفقه الإسلامي عموما. ذلك أنّ ابن عبد البر يعتبر من العلماء الأعلام الذين برعوا في علم الخلاف داخل المذهب و خارجه، فكانت له اجتهادات في فهم أصول المذهب و تحقيق فروعه، و قد وفق إلى حدّ كبير في ترك بصماته الاجتهادية، فما هي ملامح اجتهاده؟ و كيف نستطيع كباحثين الاستفادة من العقلية الاجتهادية لابن عبد البر و أمثاله في النوازل و المستجدات؟ هذا ما سأحاول أن أقاربه من خلال هذه الدراسة المقتضبة. Summary: This study attempts to uncover part of the jurisprudential heritage left by the Andalusian school. And the person of Imam Ibn Abdul-Barr, but a representative model and a practical guide to the scientific maturity and systematic excellence of the men of the school of jurisprudence Malikism Andalusian. And the belief in the need to revive the spirit of pampering and reasoning that was characterized by the Islamic jurisprudence, Maliki, why the learners became aware of the lack of Maliki's doctrine of the guide, and his reliance on opinion and criticism of the imams and elders. .. I chose to share my contribution and if a little bit in the revival of this doctrine and rooting roots. In the study of "the approach of Imam Ibn Abdul-Barr in the jurisprudential reasoning," it will be seen that Ibn Abd al-Barr was and will remain a proud scholar, particularly the Maliki school, and Islamic jurisprudence in general. Because Ibn Abd al-Barr is considered one of the scholars of the sciences who have excelled in the science of disagreement within the doctrine and outside it. He had the jurisprudence in understanding the origins of the doctrine and the realization of its branches, and it is largely based on leaving its fingerprints on the ijtihad. And how can we, as researchers, benefit from the judgmental mentality of Ibn Abd al-Barr and his ilk in the calamities and developments? This is what I will try to tell his relatives through this brief study.
