ترجمة مصطلحات مصادر الالتزام في القانون المدني المصري – دراسة نقدية -

الملخص
تعتبر الترجمة القانونية إحدى أهم الترجمات المتخصصة نظرا لدورها المتميز ليس فقط في تمكين القارئ من قراءة نصوص القانون، ولكن في جعل هاته النصوص ذات تطبيق في لغة الهدف. ويتضمن هذا المقال دراسة نقدية لترجمة مصطلحات مصادر الالتزام في القانون المدني المصري التي أنجزها المستشار مراد عبد الفتاح إلى الإنكليزية. وهي ترجمة أُنجزت لأغراض إعلامية. تهدف الدراسة إلى إبراز الصعوبات في نقل هاته المصطلحات، لاسيما وأن الترجمة تمت بين نظامين قانونيين، وهما نظام القانون المدني ونظام القانون العام، اللذين يعرفان بتباينهما الشديد فيما يخص المفاهيم والهرم القضائي والسياسي وطرائق تفسير النصوص القانونية. Abstract Legal translation constitutes one of the most important areas of specialized translation due to its distinguished role of not only making legal instruments comprehensible but also operational in a target language. The present study is a critical analysis of the English translation of the terms of sources of obligation of the Egyptian Civil Code by counselor Abdulfattāh Murād. The translation has been done for informative purposes. The aim of the study is to reveal the difficulties encountered in the rendition of such terms, notably that the translation is done from the Civil-law system into the Common-Law system. These two systems are marked by notable differences in terms of concepts, judicial and political hierarchy and the methods of construction of legal instruments. Résumé La traduction juridique est l’une des plus importantes traductions spécialisées étant donné son double rôle, car elle rend les textes juridiques non seulement compréhensibles, mais aussi opérationnels dans la langue cible. Dans la présente étude, nous dresserons une analyse critique de la traduction anglaise des termes des sources de l’obligation du code civil égyptien réalisée par le conseiller Abdulfattāh Mourad. Notre but est de déceler les difficultés rencontrées lors du passage de la langue arabe à l’anglais dans une traduction effectuée à des fins informatives du droit Romain à la Common Law. Il s’agit de deux systèmes juridiques qui sont diamétralement différents. Ces différences sont perçues au niveau des concepts, de la hiérarchie juridique et politique, et des méthodes d’interprétation des textes juridiques.
