أثر درك المعهود من أحوال العرب في تأويل آي الكتاب: وقفة نقدية

الملخص
الملخص: قاعدة الاعتبار بالمعهود من أحوال العرب من جملة المسالك الاستدلالية الدقيقة التي اعترى التخريج عليها ما اعتراه من الخطأ والزلل على غرار ما حصل مع نظائرها؛ وخصوصا فيما تعلّق بملاحظة القاعدة في طريق الوصول إلى مراد الشارع الحكيم وتأويل الوحي على ضوئه. قال ابن عاشور: «على الباحث في مقاصد الشّريعة أن يطيل التّأمّل ويجيد التثبّت في إثبات مقصد شرعي، وإيّاه والتّساهل والتسرّع في ذلك؛ لأنّ تعيين مقصد شرعي -كلّيّ أو جزئيّ- أمر تتفرّع عنه أدلّة وأحكام كثيرة في الاستنباط، ففي الخطأ فيه خطر عظيم». فكان حريا بنا عرضُ هذه القاعدة من الزاوية النّقدية كشفا للبس والإشكال والخطأ وتجليةً للحقّ والإحكام والصواب ما أمكن على حدِّ المقولة البديعة: «لولا الخطأ ما أشرق نور الصواب». وقد جاءت هذه الوقفة النّقدية في ثلاثة مطالب وخاتمة Summary: The rule of mind is known from the conditions of the Arabs, among the most accurate methods of proof, which have resulted in the discharge of what he perceived as error and falsehood, similar to what happened with its counterparts, especially with regard to the observation of the rule in the way to reach the goal of the wise street and the interpretation of revelation in light of it. Ibn Ashour said: "The researcher of the purposes of the Shariah should prolong the contemplation and verify the proof of a legitimate intention, and it is lenient and hasty in that; because the designation of a legitimate destination - in whole or in part - . It was free for us to present this rule from the monetary angle as a manifestation of shame, form and error, and a clarification of the truth, the right and the right, as far as possible, according to the wonderful saying: "Without the error, the light of truth would shine." This monetary stance came in three demands and a conclusion
