مظاهر الرحمة في الفقه الإسلامي

الملخص
الملخص: لقد اعتنى علماء العقيدة والتربية وأصحاب التصوف والسلوك بمصطلح الرحمة؛ كونه صفة من صفات الله تعالى، وخلقا من أخلاق النبي صلى الله عليه وسلم، وأخلاق الصالحين، فتكلموا عليه بإسهاب، غير أن كثيرا من الباحثين والمؤلِّفين يُغفِلون ما يذكره الفقهاء تجاه هذا المصطلح، وهذا ما حاولت تناولَه وبحثَه؛ فبيَّنْتُ مجيءَ هذا المصطلح في الكتاب والسنة، وما له من الألفاظ ذات الصلة به، ثم ذكرتُ استعمالاته لدى الفقهاء في باب العبادات، ثم في باب المعاملات، وخصصتُ فرعا لبيان ما ذكره الفقهاء مما لا يتناسب مع الرحمة؛ كمثل إقامة الحدود والقضاء ونحوِ ذلك، وفي الأخير ختمت بخاتمة وأهم النتائج والتوصيات. Summary «The Manifestations of Mercy in Islamic Jurisprudence» Prepared by the researcher: Ghebrid Sidali- Assistant Professor “A”/ Faculty of Islamic Sciences (University of Algiers -01-). The scholars of the creed, the educators and the Mystics have given great importance to the term “Mercy”, as it is one of the attributes of Allah, one of the ethics the prophet (peace and blessings of allah be upon him) and among the morals of the righteous. They spoke about it extensively. But, many researchers and authors overlook what the scholars say about this term. And, this is what I have tried to deal with and research; I have explained the advent of this term in the Holy Quran and the Sunna, and its related words, and the mentioned its uses among the scholars in the chapter of worship, and then in the section of transactions, and devoted a section to indicate what the jurists did not see befitting with mercy such as The establishment of sanctions, the judiciary and so on. And in Conclusion I mentioned the key findings and recommendations.
