دور القضاء الإداري الإستعجالي في حماية البيئة العمرانية

الملخص
تتميز الرخص العمرانية كمعظم القرارات الإدارية بكونها قابلة للتنفيذ فورا بعد صدورها رغم الطعن فيها بالإلغاء وذلك من أجل عدم السماح بعرقلة نشاط الإدارة الهادف إلى تحقيق المصلحة العامة ، لكن قد ينجم عن تنفيذ تراخيص أعمال البناء والتعمير أضرارا بالبيئة يصعب أو يستحيل تداركها نتيجة تطبيق هذا المبدأ ناهيك على أن إجراءات الطعن بإلغاء تراخيص البناء تتطلب وقتا طويلا لصدور قرار قضائي مما يجعل بعض الوضعيات تفلت من الرقابة القضائية في حينها ، ومن أجل تفادي مثل هذه الوضعيات المحرجة وبهدف وضع حد للأخطاء والمخالفات المرتكبة قبل إستفحالها وتدارك ما لا يمكن تداركه وتصحيحه بسهولة فيما لو تم تنفيذ مشروع البناء ، وضع المشرع الجزائري آلية قانونية وقائية تدعى "تدابير وقف تنفيذ القرار المطعون فيه " تسمح لكل من له صفة ومصلحة بطلب وقف أشغال البناء المخالف للقانون والتنظيم ولمضمون الرخص المسلمة للباني إلى حين الفصل في دعوى الموضوع . Abstract: Most of the administrative decisions are characterized by the fact that they are forced immediately after they are issued, despite the appeal of cancellation, in order not to allow the administration's activity aimed at the public interest, However, the implementation of building and construction permits may cause damage to the environment that is difficult or impossible to remedy as a result of the application of this principle. Not to mention that the procedures for appealing the revocation of building permits require a long time for a judicial decision , Which makes some situations get out of judicial control in a timely manner, and in order to avoid such embarrassing situations and with the aim of putting an end to the mistakes and irregularities committed before their recovery and remedying what can not be corrected and easily corrected if the construction project was implemented As a result, the Algerian legislator has put in place a preventive legal mechanism called "measures to stop the implementation of the contested decision" which allows anyone who has the status and interest to request the suspension of construction works that violate the law and regulation and the contents of the licenses granted to the builder until the case is settled.
