النظام القانوني لهيئة المراقبة التقنية للبناء

الملخص
اعتمد نظام الرقابة التقنية للبناء كتقنية تسمح بحماية المباني وملاكها في ظل تعدد المتدخلين في العملية التقنية الواحدة، مع إمكانية تنصل كلّ منهم من المسؤولية في ظل الثغرات القانونية القائمة، وتعدد المسؤولين. استحدث المشرع الجزائري نظام الرقابة التقنية للبناء بموجب الأمر رقم 71/85، مؤرخ في 29 ديسمبر 1971، يتضمن إحداث هيئة المراقبة التقنية للبناء وتحديد أساسها القانوني، المعدل والمتمم، وأوكلها للهيئة الوطنية لرقابة البناء التقنية في وسط البلاد. تُكيف الهيئة على أساس أنها مؤسسة اشتراكية ذا طابع اقتصادي، استحدث لها في فروع في عدة ولايات نظرا للدور الفعال الذي تلعبه في مجال حماية المباني والعقارات بصفة عامة. Abstract: The technical control system for the building was created for the protection of buildings and their owners because of the multiplicity of stakeholders in a single technical process .That used legal loopholes to escape responsibility. The Algerian legislature created the system of technical control of construction by virtue of Decree No 71/85 of 29 December 1971, which includes the foundation of the Commission for the Technical Supervision of Construction and the establishment of its legal basis , Amended and supplemented and entrusted to the National Authority for the Supervision of Technical Construction in the center of the country. The Commission is adapted on the grounds that it is a foundation of an economic social character, which has been developed in branches in several States because of its useful role in the protection of buildings and real estate.
