الآليات القانونية لحماية البيئة في ظل تطور الجريمة البيئية تحقيقا للتنمية

الملخص
إن الاهتمام بالبيئة وقضاياها من خلال إتباع سياسات بيئية حديث نسبيا حيث تعتبر حماية البيئة من أهم المواضيع التي حظيت باهتمام واسع في الفترة الأخيرة وارتبط هذا الاهتمام بمفهوم التنمية المستدامة التي تقوم على نمط جديد للتنمية من خلال المحافظة على موارد الطبيعة الموجودة واستبقاء جزء منها للأجيال القادمة. إن تحقيق هذه الحماية يقتضي اتخاذ إجراءات قانونية في ظل تنامي الجريمة البيئية من أجل تحقيق تنمية مستدامة. إن الدول الصناعية الكبرى هي أول من اهتم بحماية البيئة وإصدار تشريعات خاصة بها ومع ذلك تظل هذه الدول هي المصدرة للأضرار البيئية العابرة للحدود، فإن كانت هناك إرادة حقيقية لحماية البيئة من طرف الدول المتقدمة، فما عليها إلا التقليل من استغلالها للدول المتخلفة، خاصة إذا علمنا أن الجريمة البيئية معالمها وآثارها تعود إلى تلوث الوسط الطبيعي بفعل الإنسان، والذي يؤدي إلى إصابة كل الكائنات الحية بأضرار نتيجة التغيير في البيئة. The environmental concern and its issues through environmental policies is relatively recent, hence the protection of the environment has become among the most coveted topics this last period, so this concern was linked with the notion of sustainable development designed on a new kind of development through the protection of existing natural resources while preserving some of these resources for future generations. Achieving this protection requires legal procedures to the extent that there is an increase in environmental crime in order to achieve sustainable development. The major industrialized countries have taken a particular interest in the preservation of the environment and the promulgation of specific legislation for this preservation, and despite this, these countries remain the exporters of intercontinental environmental damage. La préoccupation environnementale et ses questions à travers des politiques environnementales est relativement récent, d’où La protection de l’environnement est devenu parmi les sujets les plus convoités cette dernière période, ainsi, cette préoccupation s’est liée avec la notion du développement durable conçu sur un nouveau genre de développement à travers la protection des ressources naturelles existantes tout en préservant une partie de ces ressources aux générations futures. La réalisation de cette protection nécessite des procédures juridiques dans la mesure ou il y a une croissance de la criminalité environnementale afin d’aboutir au développement durable. Les grands pays industrialisés ont porté un intérêt particulier à la préservation de l’environnement et la promulgation des législations spécifiques à cette préservation, et malgré cela, ces pays demeurent les exportateurs des dommages environnementaux intercontinentaux.
