مسعى الجزائر في تجريم دفع الفدية للجماعات الإرهابية الواقع و المستجدات

الملخص
يعتبر الإرهاب ظاهرة شديدة الخطورة، و أكثر من ذلك تعتبرها معظم القوانين الوطنية و الاتفاقيات الدولية جريمة قائمة بذاتها، وجب محاربتها بكل الوسائل، و في مختلف الجوانب، حيث بادر المجتمع الدولي الممثل في الهيئات الدولية و الإقليمية إلى حث الدول على اجتثاث هذه الظاهرة من جذورها، من خلال محاربة الفقر بوضع سياسات اجتماعية و اقتصادية تدعم بها الفئات المحرومة و وضع برامج تنموية و تعليمية من أجل توعية المواطنين بخطورة الظاهرة، و عدم الانخراط في الجماعات التي تتبناها. كما حث الدول على بذل مجهودات مضاعفة من أجل تجفيف منابع تمويل الجماعات الإرهابية بمختلف أطيافها، كتجميد الأرصدة المالية التابعة لأعضائها، و القيام بمراقبة شديدة للعمليات المالية المشبوهة... إلا أنه في الآونة الأخيرة ظهر أسلوب جديد نوعا ما لتمويل الجماعات الإرهابية، يتمثل في اختطاف وأخذ و احتجاز الرهائن طلبا للفدية، و قد أثبت الواقع أن هذا الأسلوب يعتبر تمويل بالغ الأهمية بشهادة الإحصائيات التي مختلف الجهات المتابعة للظاهرة، و كانت منطقة الساحل الإفريقي بيئة خصبة لانتشار هذه الظاهرة، التي تهدد أمن الجزائر و أضرت به، هذه الأخيرة قادت حملة كبيرة من أجل الضغط على الدول لتجريم دفع الفدية للإرهابيين، و كان الهدف من هذا البحث إبراز مختلف الجهود التي قامت بها الجزائر على المستوى العالمي والإقليمي والجهوي للتحسيس بخطورة دفع الفدية للإرهابيين، واعتبارها مصدرا مهما إن لم نقل رئيسيا لتمويل هذه الجماعات، و أنها تستعمل هذه الأموال في توسيع أنشطتها الإرهابية من خلال تجنيد المزيد من الأفراد، بالإضافة إلى القيام بعمليات إرهابية أخرى نتيجة توفر التمويل. و قد نجحت الجزائر في إقناع كل من مجلس الأمن التابع للأمم المتحدة و الاتحاد الإفريقي و جامعة الدول العربية و اتحاد المغربي العربي بتبني مقترح تجريم دفع الفدية، و تجسد هذا في قرارات واضحة، و خلص البحث إلى نتائج منها: أن بعض المنظمات الدولية الأخرى غير المذكورة سابقا لم تتخذ إجراءات بحجم ما تم ذكره، لكن البعض منها تناول الأمر بطرق أخرى غير مباشرة، كما أن تجريم دفع الفدية للإرهابيين يثير أشكالات قانونية و فقهية حول مدى شرعية هذا التجريم الذي يحتاج إلى بحث هو الآخر. Abstract: Terrorisms is considered as a very serious phenomenon , more than that, most of national lows and international bodies consider it a real crime that should be fought by all means and with all sides. Moreover ,The international bodies ,that are represented by international and territorial l bodies ,have taken an to recommend to exterminate this phenomenon completely , by fighting poverty issuing social and economical policies That support poor classes , and by issuing developmental and educational program to raise their awareness that this phenomenon is a danger , and to prevent them not to follow the group that carry their ideas. the international community has recommended the countries to double their efforts to decrease sources of finance of the terrorist groups. Like blocking their accounts that are owned by their members , and the illegal financial processes should be controlled intensively ….. . Recently , a new of way of financing the terrorist groups have emerged that is embodied in kidnapping people for the sake of asking money instead….. In fact this way of financing is very Important according to the statistics that follow this phenomenon close by and the African coast was . fertile land for this phenomenon to spread that three teams Algerian security . This former put great pressure on the countries to forbid giving ransom to the terrorist groups. The aim of this paper is to show the great efforts that have been paid by Algeria in the international , territorial , and regional level to rise people’s consciousness about paying Ransom to the terrorist groups and it is considered a main source of financing the terrorists , and it helps them to extend their activities by creating more people as well as doing more terrorist attacts because of the availability of money . Moreover , Algeria has mainly succeeded to convince the International Security Council, the African Union ,and the Arab league to adopt the proposition of forbidding ransom , and it was issued in many clear resolutions . this research has come to following conclusion: Some other international bodies not mentioned previously have not taken procedures according to what was mentioned , but some of them dealt with it in direct ways .
