الدساتير العربية في مراحل التحول السياسي

الملخص
تعد مسألة تنظيم ممارسة السلطة من القضايا الرئيسية التي درجت معظم الدساتير في العالم عموما على تدبيرها، عبر تنظيم مسارات تفويضها من المحكومين إلى الحكام، ضبط سبل انتقالها، وخصوصا إدارة حالة الفراغ أو الشغور التي قد تطرأ عليها. يؤرخ لتجربة البلدان العربية في مجال تبني الوثائق الدستورية منذ نهاية القرن التاسع عشر، بحيث تعتبر تجربة ثرية من حيث كم الوثائق التي اعتمت خصوصا خلال النصف الثاني من القرن الماضي، غير أن حالات الانتقال الثوري للسلطة التي شهدتها بعض الأقطار العربية من سنة 2011 قد وضعت تلك الوثائق موضع الاختبار الجدي لمدى قدرتها كنصوص مرجعية على إدارة عملية الانتقال. تحاول هذه الدراسة من خلال التركيز على تجربتي التحول في كل من مصر وتونس تحليل مسارات الانتقال السياسي في ضوء المقتضيات الدستورية، وتتطلع لاستشراف مستقبل الترسيخ الدستوري في النظم العربية عبر فهم سياقات بناء النصوص الدستورية الجديدة. Abstract: The regulation of the exercise of power is one of the main issues that most constitutions in the world generally have managed to organize, through organizing the paths of its delegation from the governed to the rulers, controlling the means of its transmission, and especially managing the state of power void that may arise. The experience of the Arab countries in the adoption of constitutional documents dates back to the end of the nineteenth century. It is considered a rich experience in terms of the number of documents adopted especially during the second half of the last century. However, the revolutionary transition of power that some Arab countries have witnessed in 2011 has put these documents under serious scrutiny as to their capacity as reference texts for managing the transition process. By focusing on the transition experiences in Egypt and Tunisia, this study attempts to analyse political transition paths in the light of constitutional requirements and looks forward to exploring the future of constitutional consolidation in Arab systems by understanding the contexts of building new constitutional texts.
