"رخصة البناء ودورها في حماية البيئة الداخلية والخارجية للمبنى "دراسة تحليلية على ضوء أحكام التشريع الجزائري

الملخص
لم تُترك عمليات التعمير والبناء للصدفة، بل تم تأطيرها بترسانة قانونية من أجل الحفاظ على النظام العام البيئي، لأن ذلك ينعكس على جميع مناحي حياة الفرد من أمن وصحة وسكينة ونظافة وجمال المحيط . وهذا انطلاقا من عمليات التخطيط العمراني، إلى عمليات التجسيد الفعلي للتعمير والبناء، أو ما يعرف بالتعمير العملياتي، الذي تعد رخصة البناء أحد صوره لتنظيم عمليات البناء وتحقيق أغراض الضبط الإداري. فهي بمثابة الضوء الأخضر للترخيص بالبناء، بعد دراسة الجهات المختصة من خلال الشباك الوحيد، الذي يعتبر فضاء رحبا للتشاور ثم إصدار القرار الإداري من الجهة المخول لها قانونا قصد مباشرة أعمال البناء المحددة في هذه الرخصة وتحقيق الأهداف المرجوة، لاسيما البيئية منها، بحيث يتجلى دورها في حماية البيئة الداخلية والخارجية للمبنى، كهدف رئيسي لحماية الفرد من جميع الأخطار الناتجة عن العمران. Abstract: The urbanization and construction process has not been left to chance, but rather has been regulated by a juridical arsenal ,in order to preserve the public environmental system, because this process affects all aspects of the individual's life from security, health, tranquility, to cleanliness and beauty of the environment . Starting from the urban planning processes to the actual urbanization and construction processes or what is known as the operational construction , Which the construction license is one of its forms to regulate the construction and achieve administrative control purposes, and considered as the green light for starting the work after been studied by the competent authorities, which represent a wide space for consultation and then the issuance of administrative decision from a body authorized by law to direct the construction work specified in this license and to achieve the desired objectives, especially the environmental ones; so that its role is reflected in protecting the internal and external environment of the building , and Protecting the individual from all risks resulting from construction processes .
