إجراءات وإشكالات تسوية البنايات في إطار القانون 08-15

الملخص
نظرا للوضعية التي تشهدها المدن الجزائرية من تشوه في البيئية العمرانية بسبب تزايد البنايات الغير شرعية والمخالفة لقواعد التعمير التي مست بالمظهر الجمالي للمدينة، عمد المشرع الجزائري إلى سن مجموعة من القوانين لمعالجة هذا الوضع، والتي يعتبر من أهمها القانون 08-15 المتعلق بقواعد مطابقة البنايات وإتمام إنجازها، الهادف إلى القضاء على البنايات الغير شرعية وتحسين المظهر الجمالي للمدينة، إلا أن هذا القانون شهد مجموعة من الإشكالات القانونية عند تطبيقه حالت دون الوصول إلى المبتغى منه بصفة كلية، وهذا ما سيتم التعرض إليه ضمن هذا المقال، من خلال معرفة خصائص هذا القانون والبنايات التي يشملها و كيفية تسويتها، والإشكالات التي تعترض تطبيق إجراءات التسوية . Abstract: Given the situation in Algerian cities of deformation in the urban environment owing to the increasing number of illegal buildings which are against the rules of reconstruction, this touches the aesthetic appearance of city. The Algerian legislature has enacted a series of laws to deal with this situation, and the law 08-15 is considered the most important of them all, which is related to the rules of matching and completing the buildings, in which its purpose is to get rid of these illegal buildings and improving the aesthetic appearance of the city. However, this law has witnessed a number of legal problems when applied which got on the way of reaching to its purposes in a total manner, and this will be discussed in this article, by knowing the characteristics of this law and the buildings that includes and how to settle it, and the problems that encounter the application of settlement procedures.
