مميزات رخصة البناء وأسس استصدارها في القانون الجزائري

الملخص
كان البناء وما يزال أحد أدوات التعمير المفضية للتجديد وبعث النشاط في الملكية العقارية، إذ أن البناء يعطيها قيمة إضافية في السوق العقارية ويرفع من مداخيلها في حالة إيجارها، وذلك من خلال استعمال رخصة البناء في إطارها التنظيمي كوسيلة فاعلة وضامنة للحفاظ على هذه الملكية ولبعث الزيادة والنماء فيها، لذا قرر المشرع الجزائري ومن ورائه السلطة التنفيذية تحديد أحكام قانونية خاصة بهذه الرخصة الغاية منها تمييزها كقرار إداري عن غيرها من القرارات الإدارية، وأيضا حددا الأسس التي تسمح باستصدارها ضمن الإطار القانوني المنظم لها. Abstract: Construction has been and continues to be one of the tools of reconstruction that leads to renewing and re-activating real estate property, as the construction gives it additional value in the real estate market and raises its revenues in the case of rent, through the use of building permit in its regulatory framework as an effective and guarantor to preserve this property and to increase the growth and development in it, so the Algerian legislator And behind him the Executive Authority decided to determine the special legal provisions of this license, through distinguishing it as an administrative decision from other administrative decisions and determining the basis for its issuance within the legal framework.
