عقد الامتياز كآلية لاستثمار العقار الصناعي في الجزائر

الملخص
إن الجزائر لجأت إلى استغلال أملاكها العقارية من أجل تطوير الاقتصاد الوطني وتعتبر من الموارد التي لا يمكن الاستغناء عنها في أي مشروع استثماري خاصة أن الاستثمار في مختلف الميادين أصبح هو الحل البديل من اجل تقليص الاعتماد على المحروقات، لذا فإن المشرع الجزائري أقر آلية الامتياز من أجل تسيير العقار الصناعي والمحافظة عليه وتمكينه من بسط رقابته الإدارية،وبالمقابل نجد أن المشرع قام بإصدار تشريعات متقاربة لتنظيم مسألة العقار الصناعي والغرض منها إزالة المعوقات التي تحول دون استغلال العقار الصناعي وهذا ماسيتم التطرق إليه من خلال هذه الدراسة. Abstract: Algeria has resorted to the exploitation of its real estate assets in order to develop the national economy as a resource that cannot be dispensed with in any investment project especially that investment in various fields has become the alternative solution to reduce dependence on hydrocarbons, Therefore, the Algerian legislator approved the mechanism of excellence for the management and maintenance of industrial property and enable him to extend his administrative control, In contrast we find that the legislator issued a similar legislation to regulate the issue of industrial property and its purpose is to remove obstacles that prevent the exploitation of industrial property, and this will be addressed through this study.
